Question) Explain Bailment by quoting an appropriate example and discuss the Essentials/Features of Bailment vis-à-vis the quoted example?
Answer: - In the contract of bailment there are two parties, one is known as the ‘bailer’ and another is known as the ‘bailee’. The bailer is a person who delivers the goods and the bailee is a person to whom the goods are delivered. So in the contract of Bailment the bailer delivers the goods to the bailey for particular purpose or for particular time. In the contract of Bailment it arises by delivery of the goods which goes to the bailey is a temporarily position. So when we parking our vehicles al a parking place and when we go to see the movie the particular tine period is there like often three hours when the movie will be over we will get back the delivery of the goods. So when we parking our vehicle and delivering the clothes for dry cleaning there the goods goes to the bailey for a particular time period.
One more examples is: - If we gives our scooter to get it repaired at any auto workshop then the purpose is it should be bought in the normal condition, it should be repaired. When the purpose is over we get back the goods.
So in the contract of bailment the ownership is always with the bailer and the position goes to the bailey for a particular time.
There are some essential features of bailment: -
• It is a type of contract only. Sometime it may be done according to the low or it is sometimes implies by the low.
• It is applicable only on movable goods and not on immovable goods.
• In this case the position of goods changes by physical delivery of goods.
• However the ownership does not transfer in the case of bailment. The bailey is obliged to return the goods back to the bailer or disposed of as per his
