Bill of attainder was used during the American Revolution. Colonists used it on others who remained loyal to England. The English colonists were punished with nature pain and penalties (Wilson,1996). If colonists were not given death, the individuals received pains and penalties which civilians called it bill of pains and penalties. Later in the American Revolution, James Madison proposed the Fifth Amendment along with the rest of Bill of Rights. The amendment is combined with many different safeguard and rights, which protect the person(s) from the accusation in criminal cases (Ostler, 2010). The Fifth Amendment state the right of accusation by a grand jury before charges, double jeopardy, expose of oneself, fair trial, and possession of property. A person can only be accused by a judge before any charges against the person. If the person accused of the same crime, he or she cannot be charged again. This is called double jeopardy. The Seventh Amendment mentions that a trial must be the value of twenty dollars ("Seventh Amendment. (n.d.). For cases to take place in court, it should have at least a value of twenty dollars. The last amendment, the Eighth Amendment protects people from being punished. Since bill of attainder was known as the bill of pains and penalties, this protects individuals from unusual punishments. Amendment protects individuals themselves and their property. These four amendments protect people from the bill of attainder do apply to the ex-post facto law.
