1. This scenario would be Manslaughter. Cameron was not in the right state of mind because he was “in a drunken rage” therefore his actions were made because of his loss of self-control. The killing was not planned; however there was an actus reus and mens rea due to his wrongful impulsive act that eventually led to an unforeseen death. It was a clean fight, meaning that Brandon was able to protect himself and their friends were able to break them up before anything serious happened on the spot. Unfortunately though, it was Cameron’s intentional decision to make a rash assault that caused someone’s death.

Brenda would be charged for second-degree murder. She was in the middle of committing a crime in the first place, but she intentionally chose to threaten the employees which led to the unplanned death of the manager. Her dangerous conduct and somewhat lack of negligence shows this through actus reus and mens rea. Brenda’s use of weaponry demonstrated the guilty act that was supposedly used for the robbery. This would be considered as Sexual Assault Level 2. Joey caused bodily harm to Candice and her roommate; so he could forcefully sexually assault Candice. Her roommate was knocked out unconscious, while Candice was helpless to protect herself against Joey. She too was hit in the face, disabled to escape in any way. This is considered sexual assault because Joey was too blind to presume the victim’s responses to previous physical touching. For example, Candice said “no” to him when he reached for her breasts earlier. That should have easily informed him to leave her alone, but he did not take a clue. Indirectly, she said no to consent to any form of sexual activity. This offence should be taken as indictable with a 14 year charge because he should have listened to Candice’s unwilling response. Joey assaulted her and her friend with a weapon; causing bodily harm to both. Even though his ex-girlfriend described him as a “perfect gentleman”, this still is sexual
