In detail, we will begin with the litigation process. Litigation is the process of filing a lawsuit in the court of law, which can be either criminal or civil. In your case, we use the Rules of Civil Procedure (procedures used in civil cases) and state the cause of action (the wrong or injury cause to sue the other party). The lawsuit will begin with the filing of a complaint, which is the correspondence given facts and circumstances surrounding the case and requests a decision to be made by the judge in favor of the plaintiff. You will be the person that is filing the lawsuit referred to as the plaintiff; the La Grande Fromage restaurant will be referred to as the defendant; the person against whom the lawsuit is being filed. The complaint will include the plaintiff's (you) description of the facts, the legal concept under which the case is carried and requests for specific damages.
