In 1803, Thomas Jefferson was President of the United States of America and James Madison was Vice President. In the case Marbury vs. Madison, President Jefferson commanded Madison to fire Judge William Marbury, whom was previously appointed by President John Adams as he was leaving office, along with several other judges. Marbury later sued Madison citing the Judiciary Act of 1798. This act allowed the supreme court to review cases brought against a federal official. William Marbury was a federalist which meant he was in the same political party as Alexander Hamilton and John Adams.
Thomas Jefferson during the 1790’s-1800’s while working with federalists Alexander Hamilton, his viewpoints were different. During the 1790’s Jefferson was known to be in the democratic-republican party where he progresses an ideal structure of equivalencies between money and weight standards with the American/Spanish currency. Jefferson took charge of the republicans after a conflict created two parties, republican-democratic and the federalist, who empathized with the revolutionary cause in France. It begin with the Revolution of 1800s, with John Adams and Thomas Jefferson. They both fought hard for office, but Jefferson won. This meant that he was the first president to be chosen for the new capital of Washington. One of the first things that happened with Jefferson in office was Marbury vs. Madison in 1803. “The first time the Supreme Court nullified an act of congress as unconstitutional upheld the principle of the judicial review” (Beasley 5).
Thomas Jefferson was able to understand the use of presidential power in a new way. Washington and Adam followed the criteria of separation of powers and followed what the Constitution stated, with some minor interpretations from Adams. Jefferson, on the other hand, understood that concept and put it to routine when necessary. His interpretation of the Constitution caused him to understand the vagueness of the powers the president was actually granted. Jefferson did not purposefully go into office expecting to gain more land.
Thomas Jefferson was a pioneer on the topic of church and state and how those two things have no power over the other in any way, shape, or form. Jefferson explains this when he mentions “Almighty God hath created the mind free, and manifested his supreme will that free it shall remain by making it altogether insusceptible of restraint.” Jefferson believes that God created us to be free of everything, including religion. That is why Jefferson didn’t want to give up that freedom even to the government he was so strongly a part of. Jefferson then goes on to talk about how it is extremely wrong when a church forces a man to support or change his personal views just because of an outside source, Jefferson even calls it “tyrannical” some of the methods that the church had to gain control of people.
When comparing Sam Adams, George Washington, Thomas Jefferson, and John Adams, we can see that there are some similarities and differences between the men. Perhaps the most notable relation this group has, is that they were all formal presidents and had some type of power or ownership. The qualities of all four men are often seen as opposed to each other. One similarity for example, with George Washington and Thomas Jefferson was that they were prosperous Virginian plantation owners and held slaves. Jefferson and Adams were both well educated people and knew about the law.
Hence Federalists came up with the Bill of Rights as a way to get the Constitution ratified and for people to really see a needed change. The Bill Of Rights which lists specific prohibitions on governmental power, lead the Anti-Federalists to be less fearful of the new Constitution . This guaranteed that the people would still remain to have rights, but the strong central government that the country needed would have to be approved. The 1804 Map of the nation shows that even after the ratification of the United States Constitution there still continued to be “commotion” and dispute in the country.(Document 8) George Washington stated that the people should have a say in the nation and government and everything should not be left to the government to decide.(Document 3) Although George Washington was a Federalist many believed he showed a point of view that seemed to be Anti-Federalists. Many believed that The Bill of Rights needed to be changed and modified and a new document’s time to come into place.
Edward Mitchell 10/22/2016 English 10 Essay Unit 1 Patrick Henry and Thomas Jefferson played a large role in motivating the fight toward freedom in the weeks leading up to the Revolutionary War and immediately following it. Each believed in the fundamental right to be free from rule. Patrick Henry appealed to the people’s fear of war. Thomas Jefferson was able to convince people that together, they could form a new nation. The writings of each man reveals a very chaotic time in America’s history and the leadership, determination, and boldness of Patrick Henry and Thomas Jefferson ensured that when change came, the people were ready for it.
Thomas Jefferson had a greater impact on American history than George Washington. Although not as well known as Washington, Jefferson founded America behind the scene especially using his words. Jefferson’s contributions from the Colonial era through presidential terms had a major effect on America. One of Jefferson’s major and early contributions during the Revolutionary War was writing the Declaration of Independence. This document explained in writing for their reasons of separation from Great Britain.
Throughout her essay, Ehrenreich continuously builds her focus with pathos in her use of parenthesis. Parenthesis is a form of hyperbaton that inserts whole words, phrases or sentences that function as an aside. With her use of parenthesis, she further clarifies and inserts her thoughts about the different aspects about her job. She criticizes how “Managers can sit--for hours at a time if they want” (pg 130). She wonders how many calories she burns doing the menial work she does to keep busy (pg 130).
When comparing documents such as the Declaration of Independence, the U.S. Constitution and Thomas Jefferson’s letter to the Danbury Baptists, one must consider the dates on which they were drafted upon along with the current state of American government. These two points are necessary when determining the reasoning behind why each document was drafted. The Declaration of Independence was the first of these three documents to be written and was used to establish that the citizens of the United States of America were free from the rule of Great Britain. When writing the Constitution, the Federalists, which included Alexander Hamilton, James Madison, and John Jay, had stated the rights and liberties of the civilians within the Constitution. Alexander Hamilton, a federalist, believed that if a Bill of Rights was to be created then the whole idea of republican government would fall apart. As stated in a federalist letter, " [the constitution] would contain various exceptions to powers not granted, and on this very account would afford a colorable pretext to claim more than were granted”(Federalist No. 71, Alexander Hamilton). The Constitution stated that all free people had equal rights. Rights that were implicit, which connected to fixing all the problems within the government and the people.
Both Thomas Paine and Thomas Jefferson like many of the founding fathers of America share a ideology concerning independence and freedom in general. Although the two were notably talented writers, the difference in their arguments was their respective deliveries, writing styles, and their timing. Personally, I agree more with the way Thomas Paine chose to present his point of view. Common sense, for example, was a significant eye-opener for many Americans. One of the only reasons it made such huge impact was because it was written in a style that was easy to understand for the average American.
Thomas Jefferson once wrote to James Madison: "A bill of rights is what the people are entitled to against every government on earth" seeing that some Federalist was skeptical of the idea of listing rights. James Madison called it "parchment barrier" but regardless of his skepticism the declaration of rights was added to the US Constitution13. Initially, some amendments proposed by Madison were rejected including his "proposal to extend free speech protections to the States. " What followed were debates over spelling out what constituted the Bill of Rights, especially the "due process of law" preserved under the 14th Amendment. However, it was not until in 1925, in Gitlow vs. New York, 268 U.S. 652, did the US Supreme Court found
