The responsibilities of an employer and employee under health and safety legislation, was founded in 1974. Act 1974 is a law made to secure the health, safety, wellbeing of people at work and to prevent unnecessary risks. An employer’s responsibilities under health and safety legislation, requires the employer to be responsible for the health and safety of any person in their premises, which includes employees, customers, suppliers and the public. Employers should hire a certified person in charge of health and safety, however in small businesses that person is usually the owner or a trusted member of staff.
The local government uses the California building code as a set of standards to be imposed on construction. In order to obtain a “Certificate of Occupancy” (which pronounces a building fit to inhabit), the building department inspects the construction project in order to ensure that it complies with California building code. The Occupational Safety Health Act helped create safety codes that all businesses must follow. These codes helped prevent deaths and injuries. The Occupational Safety Health Act states that in order for a job to pass inspection, it must have clear routes to all exits, several working fire exits, unlocked doors during working hours, firefighting equipment that everyone knows how to use, fire sprinklers, and a fire evacuation plan in event of fire (Lange 84). These regulations all help prevent chaos during fires because it allows for easy access to exits in an emergency, and it gives an opportunity to stop the fire before it becomes out of control. Not only did the Occupational Safety Health Act provide safety codes, but it also deals with on the job injuries, illness, and deaths (Lange 84).

It must include information on hazards, risks and measures for each specific task in the work and the names of emergency staff and safety representatives (HSA, 2005). The section also included information details that need to be given to employees of another employer or company working in the place of work, duty of safety representatives on risk assessments, fixed-term and temporary employees, and third party temporary employee.

Health and safety at work act 1947 The health and safety at work is the legislation, which covers the employees’ health and safety in the UK. The law requires a high level of management that employers must follow, they must look at risks and assess them and take a sensible measure to prevent these risks from happening. This policy and procedures is for Risk assessments and the fire policy/procedure. This promotes safety because care organisations have to make sure that they are able to provided a safe environment in a health and social care setting.

There are many ways in which they have to comply, and the employer is responsible for the health and safety procedures and these will vary depending of the type of school, but they are required to carry out risk assessments and suitable procedures for any new situation which may increase the risks for example when on a school trip, comply with, complete and allow access to any appropriate paperwork which could be requested during an inspection under the Act, provide a school health and safety policy and ensure that all staff are aware and understand it. It is vitally important that all areas of the school are safe for children. This includes in addition to those mentioned above ensuring that classroom furniture, PE equipment and other specialised equipment such as that used in chemistry etc. as well as playground furniture are in a satisfactory condition in order to avoid any accidents while learning or playing

Also, these regulation state that disposable gloves and aprons must to be provided for cleaning and handing chemicals.
