Raysinger, where it was questioned how liable one can be held for injuries to one of their guests when the social host is the provider of alcohol. It was concluded that a social host cannot be held liable when a one provides or serves alcohol to its guests. This case was different from Congini v. Drinking and driving will never stop. Everyone who goes out and drinks doesn’t always have a designated driver. Most people leave work and depending on how their day was they may need a drink or two. Also if they had a bad day or got fired from the only income they had to depend on it might lead to more drinks than they need.
A number of problems surround the second question; the most obvious of which are limited time, the limited capacity of human foresight to calculate the maximum number of happiness, and the inability of the theory to advise on the time frame utilitarianism is to be applied to; how do you know the maximum number of happiness for the next 10 years doesn’t mean greater overall unhappiness in the next 50 years, so what time period should one keep in mind when considering an issue from a utilitarian stand point, 1 year, 5 years, 10, 20? This lack of clarity further adds to the impractical nature of the ideology. There are a myriad number of situations which seem very difficult to resolve without employing utilitarian principles and a very good example is the widespread use of utilitarian principles in bioethics. The best example here would obviously be the famous case of the conjoined twins Mary and Jodie. Alcohol abuse and alcoholism seems like an issue that keeps getting increasingly worse each year in the United States. According to USA Today and Centers for Disease Control and Prevention both say that approximately 6 people die from alcohol poisoning, caused from binge drinking, each day, which amounts to roughly 2,200 people each year. The National Institute on Alcohol Abuse and Alcoholism says that “In 2013 an estimated 697,000 adolescents ages 12–17 (2.8 percent of this age group) had an [alcohol use disorder]” (“Alcohol Facts”). Something has to stop and something has to change from preventing this more because 6 people dying each day from binge drinking alone is a lot, not to mention that 12-17 year olds are having alcohol problems at such a young age. Lowering the drinking age will enforce this act even more, promoting more drinking in fact.
Utilitarianism is a teleological ethical theory based on the idea that an action is moral if it causes the greatest amount of happiness for the greatest number of people.
