On October 23, 2015, at approximately 2050hrs I made contact with Austin Quinn at the Brookfield Police Department in reference to petit larceny. Quinn was arrested on sight. I read Quinn his Miranda Rights at approximately 2055hrs. Quinn advised on 10/17/2015, at approximately 2000hrs, Dallas Epperson and himself went to Wal-Mart in Brookfield to buy a drink. Quinn advised Epperson had got his ears pierced and bought something at Wal-Mart but didn’t know what Epperson bought.

The United States Congress created the Federal laws to safeguard citizens in the United States of America. Criminals that violated the federal laws are automatically prosecuted in the United States District Court. Criminals can fall into two different categories, such as felonies and misdemeanors. Felonies can lead to more than a year in prison, while a misdemeanor can lead up to one year or less. The United States Congress has the authority to decide whether a criminal deserves to be charge for a felony or a misdemeanor; however, State legislatures makes the decision on criminals that violate state laws.[i]

Lawful Lawbreaking? Civil disobedience is defined as a refusal to obey governmental demands or commands especially as a nonviolent and usually collective means of forcing concessions from the government (Merriam-Webster). People today will argue as to whether or not this is a good or bad movement. The way I see it, there is no issue with non-violent disobedience. People who do movements like this do not want to hurt anyone, they would simply like people to pay attention to their cause.
Wrongful conviction has been an emerging and tremendous dilemma in our society since the discovery of DNA analysis. This is a very recent study that has presented another form of evidence that can prove an individual's innocence in ways never before. Forensic scientist collect DNA evidence and run tests to see if there is a match to DNA samples collected at the crime scenes. However, the justice system has not taken this new science into consideration because many influential individuals, such as judges, prosecutor, jurors, and attorneys, do not understand this new science. This leaves the burden to forensic scientist to explain DNA testing to representatives of the court system.
Despite the fact that mandatory minimums can have negative consequences on first time offenders, I still think that justice is best served with “mandatory minimums” because it prevents judges from being too lenient with the sentences of serious crime. For example, if a violent person commits murder and the judge only sentences them to eight years because they are a first offender, many would agree that an eight year sentence for a murder is too lenient and could encourage the criminal to be a repeat offender. Another reason justice is best served with mandatory minimums is that it can prevent people from committing certain crimes because the consequences for committing the crime may be enough to deter them. To fully understand the sentencing phase of criminal court proceedings, it is important to examine how sentencing affects the state and federal prison systems, learn the meanings of determinate and indeterminate sentencing, and understand the impact Proposition 57 has had on sentencing in California.
The present law on non-fatal offences can be found under the “Offences Against the Person Act 1861” and the “Criminal Justice Act 1988”. At first glance these acts seem to be comprehensive, however, they have been deemed unfit for purpose. In reality, the statute language is obsolete, which may lead courts to misinterpret parliament’s purpose. More importantly, there is no statutory definition of assault or battery, leading to further confusion as to what crimes constitute these offences.
