The 3 main ways someone can prove sexual harassment are quid pro quo, hostile environment created by supervisors, and hostile environment created by coworkers or nonemployees. In the case of quid pro quo, to prove sexual harassment there must be evidence that rejecting a supervisor's advancements will adversely affect “tangible employment.” This would mean that rejecting to perform sexual demands for a supervisor would negatively result in cases such as, hiring, promotions, or firing. The second method of proving sexual harassment is to demonstrate that a hostile environment was created by a supervisor. In the case of disparate impact, out book defines the practice to mean employers “engage in an employment practice or policy that has a greater adverse impact on the members of a protected group under Title VII than on other employees, regardless of intent.” The claims do not need require proof of discriminatory intent but the plaintiff must show that the the disparity between the proportion of minorities in the labor pool and the new hires. Companies can defend against these claims by demonstrating ratios such as the 4/5th rule or standard deviation rule, which outlines that the company did not discriminate based off of the hiring pool. The three different types of strategies used in the planning process outlined by out book are corporate strategy, competitive strategy, and functional strategy. A company’s corporate-level strategy identifies what assets comprise the business and they correlate with each other. For example a concentration corporation will have a narrow market in which they will offer one product. Whereas a diversification corporate strategy like, Pepsico, operates under many different business with a vast array of products, in which they own. Next a company must establish a competitive strategy. This is the process where companies will identify who their competitors are and how they will differentiate themselves in order to compete. For example, Pepsi competes with Coke and has developed themselves as a brand for younger and more adventurous consumers. Lastly, the functional strategy is where companies will lay the foundation with what needs to be done within the company to create their products, such as establishing a high functioning production, marketing, and so forth.
