In document C, there is a very useful chart that shows one way that each of the three branches of government (executive, legislative, and judicial) holds a little bit of power over the others. This is good because it means that no one part of government is above or below the others in terms of power, and there is always a way for one of them to be “checked” if they are becoming too tyrannical. For example, the President (executive) can veto Congressional legislation, but Congress (legislative) can impeach the President if necessary. Being able to “check” each other is one of the ways that the Constitution kept one group from having too much power. Another benefit of having the checks and balances system is that none of the three branches is so far apart from each that they have no power over the others, but they are far enough apart to prevent the power from accumulating.
There are many checks and balances placed upon each of the three government branches. These checks and balances were created to insure that each branch would have nearly equal power. In this way, no branch will be able to rise above the others in power. This system has worked very effectively over the past years, however, there have been several situations over the past years in which this system has been challenged. Leaders of the Executive branch such as William Howard Taft, or Franklin D. Roosevelt have tried to expand the power of the executive branch.
Former US Representative, Ginny Brown-Waite states that the “American government was founded on a belief and a faith in God and in doing what is right and just.” Brown-Waite, sums up what the US was supposed to be when it was originally developed in one sentence. The men who wrote our constitution, knew that it was important to build it with the foundation of doing what is right. At its prime, the American government was one of the best in the world. The constitution was a good idea, it’s a practical government, and it is a feasible government.
The Preamble settles and organizes the United States and help them become a more organized place for their good. The plan was to establish a Constitution for the United States of America and with this it will help us “...form a more perfect union, establish justice, insure domestic tranquility, provide for the common defense, promote the general welfare, and secure the blessings of liberty to ourselves and our posterity,” With the Preamble America had a way to move on and improve in
However this idea was eventually scrapped and they wrote a whole new constitution. This constitution would protect America from tyranny, so they could keep a civilized and united country. The Constitution that was made helped defend America from almost all types of tyranny and is still helping us hundreds of years later. One way the Constitution prevented tyranny is by supporting Federalism.
After fighting for so long and hard to secure independence from the British rule, the young United States of America needed to come together to form a strong nation. Having literally sacrificed blood, sweat, and tears to free themselves from the tyrannical oppression of an over-powered central government, the people wanted to ensure that they would not be trading one for another. There needed to exist a means to effect a measure of equality and security for the newly founded country. The Constitution aimed to do just that.
Historical events or contemporary examples show interactions among the branches of the federal government. These interactions are in the form of checks and balances. An example of this would be S.T.A.R.T. A treaty proposed by President Obama in 2010. Two branches had to work together to ratify this treaty, the Executive and Legislative. S.T.A.R.T. is a treaty “President Obama and Russian President Dmitry Medvedev signed [that was a] major nuclear arms control agreement that reduces the nuclear stockpiles of both nations” (Obama).
Some examples are: The Legislative Branch; has the authority to overrule a president’s veto but requires a 2/3rd vote, they are also permitted to approve treaties and impeach a president if the cause is just. For the Executive branch, they are able to appoint federal judges for the Supreme Courts, and capable of vetoing bills from passing if he or she sees fit. For the Judicial Branch, as they are to interpret the Constitution they would be free from the influences of the executive branch in order to make sure the president him/herself is following the laws of the land. The U.S’s Checks and balances
The Framers anticipated that the U.S. Constitution would need to be amended from time to time, what James Madison referred to as “to originate the amendment of errors.” he 55 Framers who met in Philadelphia during the spring and summer of 1787 understood that they were drafting a Constitution to last a very long time. “We are not forming plans for a Day Month Year or Age,” delegate John Dickinson wrote, “but for Eternity.” Of course, a document designed to last a very long time must include a method of amendment. In crafting their amendment procedures, the Framers resorted to two mechanisms widely employed at the time: legislatures and conventions.
The framers of the United States Constitution intentionally built points of conflict and tension into the constitutional system for several reasons. First, the framers established a system of checks and balances among the three branches of government—the legislative, executive, and judicial branches. This division of powers creates a dynamic where each branch has the ability to limit or counteract the actions of the other branches. This intentional separation of powers leads to inevitable conflicts and tensions as each branch seeks to assert its authority and protect its interests. Next the framers created a federal system of government, where power is divided between the national government and state governments, also known as federalism.
“The preamble of the Federal Constitution says: ‘We, the people of the United States, in order to form a more perfect union, establish justice, insure domestic tranquility, provide for
The Checks and Balances are the ways that the three branches of government check each other to make sure each one doesn’t go crazy with power. Legislative Branch checks the Judicial Branch, Judicial Branch checks the Executive Branch, and the Executive Branch checks the Legislative Branch. (Document C). This helps guard against tyranny because each of the branches can check the other one to make sure the branches don’t get too much power. The final way that the constitution helped guard against tyranny was the Big States and Small States Compromise.
The constitution of the United States is an insightful and revolutionary idea of how a government should be practiced in order to prevent a greedy, corrupt form of government from establishing and taking over its people. The US government is founded on the principle that it works for its people, meaning that whatever is legislated is meant only for the benefit of the American people. However, the Constitution is at this point flawed due to the fact that many of its proclamations are vague and outdated, and has to be left to interpretation as to what the framers truly intended of it. This is dangerous because it further divides the nation when Americans believe in different forms of what is constitutionally righteous, and this may start a civil
Therefore, power has been justly distributed between each division of government. Checks and balances are yet another form of separation of powers in the government. As the Constitution was initially written, there were checks and balances preventing any one branch of becoming too powerful. Since we still follow the same Constitution (with a few amendments) those checks and balances are still used.
Do ordain and establish this Constitution for the United States of America. ”When it says establish justice ensure domestic tranquility, it means it will ensure justice for people, and ensure domestic tranquillity means to keep the peace in America. This part of the preamble is important to me because it keeps peace between people who have different looks on things and with different backgrounds. In the preamble it also stated “secure the blessing to ourselves and are posterity”. That means it saves our blessings of our hard earned rights and keeps us free and from a tyranny government.
