You interview the student(s) and.... the 4th grader is worried and feels unsafe even though he has never been harmed by the older student. The 6th grader however denies ever saying anything to the younger student and states he is just trying to get attention. The 4th grader is tearful and seems very concerned, he is very shy and does not want to talk much about the situation, he says he is afraid to get the older boy in trouble because he might beat him up even worse. The 6th grader has an attitude and a long list of disciplinary issues starting from the 5th grade.

Explain Rationale for Threat Categorization: there is a clear and direct threat that is aimed towards the younger student, whether he is serious in carrying out the plan to beat him up does not matter. His threat towards the boy implies danger, specifically towards the young boy and specifically after school. The action plan should be implemented quickly to prevent any harm from coming to the younger boy. This may be a typical case of an older student bullying a younger student but it still deserves immediate action.

The older boy should be disciplined based on the schools code of conduct, and issued a counselor to deal with self esteem issues related to his desire to bully others. He can also be required to take an anger management course paid for by the school to help manage his outbursts.
