Driving under the influence is very dangerous and in a lot of cases, people are seriously injured. In many cases, there is a lawsuit for the accident. In the hypothetical situation for this essay, there are a couple of ways people can get sued. In this situation, Helen Brown can sue Rachel Goodman and Rachel Goodman can sue her employer, Michael Thomas. Helen Brown was the one who was injured in the car accident due to Rachel driving under the influence. Since Michael owns the establishment, hosted the party, and provided the drinks, he could be held liable for Rachel’s damages that were a result of the mislabeled wine coolers. This essentially creates a chain of liability that includes Rachel’s actions and the actions of her employer. These lawsuits would be based on principles of negligence and liability of the host. In the negligence case between Rachel and Helen, the legal grounds include duty of care, breach of duty, causation, and damages. All drivers are responsible for the care of other motorists when they are operating a vehicle, and they are required to do so safely and responsibly. When Rachel swerved out of her lane and struck Helen, she breached the duty of care. The negligence of Rachel caused the accident, the damage to property and her and Helen’s injuries.
