A video by the name of “The Invisible Constitution” is a demonstration based on a book that Laurence Tribe wrote also called “The Invisible Constitution”. Tribe feels that the constitution is a living document because just like human beings, there is change. The constitution does not physically change, but every word in the constitution can be questioned and interpreted differently by each individual. Tribe discusses his own opinion on the constitution and he thinks that most of the document is “invisible”, while others may think that the constitution means exactly what it says.

This document was intended to be an improvement of the Articles of Confederation, in which the ending result was an entirely new government called the republic. The idea of institutionalizing a constitution created differences between the participants of the meeting. Those who opposed the idea of a new government and the constitution were called the Antifederalists and those who supported the ratification of the Constitution were federalists, which is the idea of federalism vs. state’s rights. The United States has worked under two constitutions. Articles of Confederation was the first constitution in our nation. It was in effect from March 1st, 1781, after Maryland ratified it. Articles of Confederation was replaced by The Constitution on June 21, 1788, which was ratified by New Hampshire. The main principles behind the modern constitution were human rights, accountability, power separation, representative government, and independence of judiciary.

The two constitution I am gonna compare are the United States of America constitution, and the Canadian constitution. Like the U.S constitution, the Canadian constitution is mostly the same since it got many of its laws from the U.S constitution. Both constitution have many provinces that they are divided into since the place is too big, as well as to divide power, as well as that they both have an executive power since they need someway to be able to divide the power. Unlike the U.S, Canada has a Queen that controls the executive government. Canada has its own version of the Bill Of Rights called Charter of Rights and Freedoms in the end of its constitution.
Why was the Constitution a controversial document even as it was being written? Established in 1787 The Constitution was a controversial document because it was a document that could both solve the nation’s hardships and warped the Republican foundation. The Constitution on one hand would give the people a voice and the other would control the nation through a monarchy system. One of the controversies that arose from the creation of the Constitution was the question of management of commerce.
Overtime in history, the United States has developed documents from the Puritans idea of Covenant to what we have today-The Constitution of the United States. The Puritans eventually escaped to freedom in America from England and then later, helped show colonists through experience and history how to develop certain parts of The Constitution. Most events leading up to writing The Constitution, have parts in it that fixes problems of specific events so that if another event similar to the one prior happens, the United States would already know one solution. Throughout U.S. history, there have been people and their cultures expand during and after the Puritans idea of Covenant, such as the Quakers, the Pilgrims, and the colonists.
For example, the legislature in the Article was unicameral, called Congress, but the Constitution is bicameral, called Congress, divided into the House of Representatives and the Senate. Next, the member of Congress in the Article is between two and seven members per state, but in the Constitution, it is two Senators per state, Representatives apportioned per population of each state. Also, in the Article there was no executive, but in the Constitution the president is the executive. Lastly, the power to coin money in the Article it was the United States and the states, but in the Constitution, it is the United States
The U.S. Constitution is a Living Document Since society has changed dramatically between the eighteenth and twenty first century, the U.S Constitution should be considered as a living document because it is not applicable in today's society and therefore in need of some changes in order to fit into today’s society. When our founding fathers wrote the constitution they did not have in mind all the technological advancements the U.S. will one day have. Such as the internet, television, radio, and so on. Other’s will say that if the constitution was considered a living document then judges will take advantage and manipulate the constitution to their benefit, but they don’t realize that people already manipulate the constitution. There were laws that contradicted the constitution like the Judiciary Act of 1789, which contradicts Article III of the Constitution in the Marbury v. Madison case.
Compare the history of how we got to our current constitution to something else and why that is so? A constitution is literally a rule book. It states many different things in it. It sets up major governing institutions, assigns institutions their given power, and places explicit and implicit control on power that given to them. A constitution establishes literal legitimacy, it’s the real deal.
