An important case that shapes how things play out from then on lies with Brown V. Board of Education, but its predecessor Plessy V. Furguson gives some context about how even with the end to slavery and African Americans subsequent gaining of rights, racism and prejudice was still active and even more so encouraged (U.S Court). The court established that even though races could be segregated, they must be considered inherently equal in the eyes of the law (U.S Court). However the Brown V. The Board of Education case shows that this notion is untrue, as facilities segregated were inherently unequal, the court ultimately ruled this practice illegal and led to the desegregation of schools and other segregated public spaces (U.S Court). But even with this ruling from the court many schools across the country, particularly in the south, resisted the ruling and continued to maintain segregated schools (National Museum). A key point of interest that came from this, is the incident with Little Rock High School with nine students becoming icons (National Museum).
However, the Supreme Court had declared that the legal separation of blacks and whites (segregation) in public facilities was illegal. In 1954, the right to an equal education was given to black students by the United States Supreme Court. Unluckily, even after 3 years, African Americans were still being forced to attend separate and subordinate schools. Despite that racial segregation in public schools became unconstitutional due to the notable Brown vs. Board of Education court case in 1954, that was merely the beginning of the transformation of American society and acceptance. Subsequently, the new racial movement allowed other minorities to have the courage to defend their civil rights. This was not only a historical moment for minorities, but for women as well. Women, regardless of race, revolted against oppression and traditions. To be politically correct was now discretional.
American citizens during the 1960’s were either completely for desegregation, or completely for segregation. There was no middle ground between the two. The Civil Rights Movement was reinstituted after the Brown vs. Board of Education supreme court case declared state laws establishing separate public schools for black and white students were unconstitutional. This gave a new, and vigorous offense, to the African American community in their fight for independence. With the conclusion of the Brown vs. Board of Education case, a new, modern era of equal rights initiated and two leaders emerged as the front runners.
On May 17th, 1954, the Supreme Court of the United States (SCOTUS) decided that segregation in public schools violated the 14th amendment. Therefore Brown v. Board of Education was the earliest major event to occur in the Civil Rights Movement. As a consequence, the Supreme Court’s historic decision boosted the morale of civil rights activists across the country (especially in the South) and motivated them to do more about racial inequality in America.
The significant legacies in the case of Brown v. Board of Education are the confrontation of the ideology with its constant denial of separation was not equal, the right to quality education, “dignity to self,” the creation of black middle class, and the setup of educational standards for personal achievement. Prior to the decision of Brown v. Board of Education, the federal government powered to enforce segregation under the Supreme Court’s ruling of permitting “separate but equal” doctrine towards the treatment between African Americans and whites. The following of the decision of Supreme Court’s ruling in the segregation in public schools considered as a violation to the Constitution shifted the ideas of the Justice Department and federal officials to acceptance of integration instead of obstruction. This being said, if segregation continued in schools across America then the government would then start to take away public school funding. Brown v. Board of Education Of Topeka is one of the most well know cases in recent American history. To start, not too long after slavery ended, it was not uncommon nor unjust to have everything from local businesses, to water fountains and restrooms be segregated. So, it is safe to say that the majority of American states had segregated public education; which was made legal by Plessy v. Ferguson in 1896. This legislation stated that it was constitutional to have separate schools, as long as both, black and white schools were equal to one another. (McBride).
African-Americans have been treated unfairly throughout the years and it has still not ceased. In the articles "Blacker Than Thou," "White Rage," and "The Condition of Black Life Is One of Mourning," there are examples of this unjust treatment. For instance, in "The Condition of Black Life Is One of Mourning," the author demonstrates that black people are stereotyped to be lawbreakers, and some police have used lethal weapons against them unnecessarily, due to their race. Also, in "White Rage," the author describes occasions from the past, such as Brown v. Board of Directors case of the U.S. Supreme court which established that segregation of primary schools based on race, as dictated by the ‘Separate but Equal’ doctrine, was unconstitutional based on the reinterpretation of the 14th amendment and thus, put an end to state-sponsored segregation in the US. Decades ago, children of various races could not go to school together in many locations of the United States. School districts could segregate students, legally, into different schools according to the color of their skin. The law said these separate schools had to be equal. Many schools for children that possessed color were of lesser quality than the schools for white students. To have separate schools for the black and white children became a basic rule in southern society.
The segregation of schools based on a students skin color was in place until 1954. On May 17th of that year, during the Supreme Court case of Brown v. Board of Education, it was declared that separate public schools for black and white students was unconstitutional. However, before this, the segregation of schools was a common practice throughout the country. In the 1950s there were many differences in the way that black public schools and white public schools were treated with very few similarities. The differences between the black and white schools encouraged racism which made the amount of discrimination against blacks even greater.

This case was a landmark United States Supreme Court case in which the Court declared state laws establishing separate public schools for black and white students to be unconstitutional. The U.S. Supreme Court's decision in this court case changed majorly the history of race relations in the United States. On May 17, 1954, the Court got rid of constitutional sanctions for segregation by race, and made equal all education opportunities as the law of the land.
If African Americans were found having an equal opportunity at an education, the punishment ranged from fines and imprisonment to even death at some points. When slavery had ended, the south still limited the African Americans the access to a fair education due to the Jim Crow laws. Most states required blacks and whites to attend different schools, which caused a major uproar on discrimination and inequality from the social standpoint. Many of the African American activist had tried to challenge segregated school systems legally, but had failed until the case of Brown v. Board of Education in 1954. The NAACP decided to represent the Brown family, which was finally taken to the Supreme Court.
The decision behind Brown versus Board of Education is bigger than a “won case “but a case that helped Americans realize interaction, companionship, and learning in a school setting among different races is detrimental and effective. The theory behind the concept was for Americans to change bias thought processes of race and notice success and academic goals is not associated with skin color. For generations to come, it is our responsibility now to reverse racial desegregation not only in schools but everywhere.
