In this episode of “Criminal Injustice,” with David A. Harris, Harris and guest Beth Schwartzapfel, who is the author of two articles on this set of problems and is a staff writer on the Marshall Project, talk about the Brady v. Maryland rule as well as how this rule is violated daily to the point where it negatively impacts the whole system and why it is long overdue for change on this issue. Back in 1963, the Supreme court decided the case of Brady v. Maryland. In this case, the government withheld crucial evidence from the defense. The supreme court said that if the prosecution has material evidence in its possession that would exonerate or even lessen the punishment the defendant then the prosecution would have disclosed that evidence.
The reason O.J. was found not guilty of murder and acquitted in criminal court, but found guilty of the tort of harm and ordered to pay damages in the civil court lies in the structure of our legal system, in regards to criminal cases and civil cases. When talking about Bill Cosby and him allegedly raping over 50 women, it is going to take time to get to the bottom of this trial. I feel as though if the women had been rape they should have said something back when it first happened. This has been untried and unpunished fro fifty years; why would anyone take the time out to try and put him in jail all these years later? I feel as though some of those women are lying because if the rape was that serious, they would have spoken up when it first happened. If I were to get raped, I would go to the police right after it happened and I would put the man that did it away fast so he wouldn't hurt anyone else again.
