The views of a tenant and a landlord are very different. Many people are constantly being deprived or stripped of their rights as a tenant simply because they are unaware of their rights. Some landlords pick up these actions and instead of informing the tenant of these rights, they take advantage. In the city of Philadelphia, there are rules and regulations that govern both the landlord and tenant. The authors of business law states A landlord has a duty to deliver the premises in a habitable condition and a continuing duty to maintain the habitable condition. The implied warranty of habitable requires that a landlord meet all standards set by the local building code, or that the premises be fit for human habitation (Beatty, Samuelson, & Abril, 2014). The leakage from the roof caused a tremendous amount of damage to his property and made the apartment unsuitable to live in. The process, in which; Larry would first have to give written notice to Roger. Since Roger has been paying his rent on time, Larry would not be able to give Roger a notice of vacancy. Larry would have to give a 30-day notice to vacant the property. If Roger has not vacated the premises by 30-days then the landlord must file an Eviction Complaint against the tenant in Landlord-Tenant Court (Baritz, 2015). After that, the Court will send a copy by U.S. mail to the tenant providing the date and time the tenant must appear in court along with the reason as to why he has been summoned.
