Hunger, as per the oxford dictionary has been described as a feeling of discomfort or weakness

caused by lack of food coupled with desire to eat.

Facts: Pi is shipwrecked with his mother, a French cook and an injured Taiwanese sailor in a lifeboat. They drift several weeks in the middle of the sea before the cook butchers Pi’s mother and the sailor and eats parts of their flesh to satisfy his hunger. Left alone with the cook, Pi stabs him to death and eats his heart and liver. This final act of cannibalism was put to trial in the court and pi was held guilty of murder and was sentenced to death by the judges.

Foster, J. According to justice foster the defendant was in a state of nature at the time he killed the cook, so the law of nature should apply and this case cannot be tried underneath the laws of common wealth. The law of nature allowed agreeing to one sacrificing life to save others. He also thinks approach must be taken to the statute. Judges can find an exception to the law by implication, as the Courts had earlier done with self-defence.

For this I think hang to death isn’t favorable and feasible. I believe law should not govern these extra ordinary cases since they are governed by the state of nature and not by ordinary state laws. Although the common ground by which these cases are comparable are that in both the cases, the outer world could not help them or interfere with what happened in that situation. In order to provide justice in such cases we should not follow our law blindly. Proper thought and rationale should be used before giving judgement. The moral and circumstantial aspect of the crime should also be taken into consideration. In manner we can provide better justice for such extraordinary
