Mothers
Under Sunni Law, according to Article 19 of the Law of Inheritance compiled by AIMPLB, a mother occupies a position that is considerably inferior and is attributed to strong patriarchal values that prevailed in the Arab society. When a person dies without issue leaving behind parents and a husband/wife then the mother is entitled to 1/3rd share. When two or more brothers or sister (full, consanguine or uterine) exist then she inherits 1/6th share of the property. The father takes 5/6th share. As relatives grow, the mother’s share decreases. Brothers and sisters have superior rights over mother. Under Shia law, according to Article 40 of the Law of Inheritance compiled by AIMPLB the mother takes 1/3rd share of the whole estate even if it reduces the father’s share (under existence of other heirs).

If there is no child or descendant of a son then her share is 1/4th of the estate. In case of the man having multiple wives, then all the widows take a share. A wife (and husband) is not entitled to a ‘Return’ as long as there is any other heir. If a deceased dies leaving widow/s and brother/s then the widow is entitled to 1/4th of the property and the rest get the residue. Under Shia law, a childless widow is entitled to get her share (1/4) in the inheritance only from the movable property left by her deceased
