C. Precedent The law is unconstitutional not only due to the meaning of the text itself, but also from many cases of precedent. District of Columbia v. Heller, 554 U.S. 570 (2008) and McDonald v. City of Chicago, 130 S. Ct. 3020 (2010) have already established the importance of the Second Amendment, but there are other cases as well that back up the courts decision claiming the ban on carrying a concealed weapon is unconstitutional. In Bliss v. Commonwealth, 2 Litt. 90, (KY 1822), established that the right to bear arms was for defense against themselves and the state. This case consisted of a man carrying a concealed weapon in his cane and it is similar to the one in which we face today.
There are many opposing views pertaining to this argument, but if everyone was just able to come to an agreement; the world would be a better place. I believe our right to self arm is a constitutional right; however, I do not agree with open carry. While Dan Griffin makes some excellent points in favor of open carry in his article entitled “The Pro Liberty Choice: Dispelling The Myths of Open Carry,” the times in which we currently find ourselves living makes carrying a weapon openly and in easy reach a very dangerous proposition. Temperatures are running very high in the current political climate and easier access to a gun is dangerous both to the disagreeing parties and even more so to the police office who attempts to mediate the disagreement. First, the report states that “states have granted concealed carry permits to domestic abusers, criminals, the mentally ill, and suicidal individuals, among others.” This can be proven false right away, since to own a concealed carry permit, let alone most kinds of firearms in general. An applicant has to pass a background check. So anyone with a criminal record or who is mentally unstable won’t be able to receive a concealed carry permit. Later on, the report claims that in 29 instances, people used their concealed carry permits to carry out mass killings.

The Second Amendment states that one has the right to bear arms. This right can be taken away from one when they do some sort of crime that goes against this and gets their right taken away from them. Around 3 million americans carry a gun with they all the time with a concealed weapons permit. That number is 20% out of the 15 million americans that have a concealed weapons permit. We should not get rid of the right to carry a concealed weapon though there are exceptions depending on the person and their history.
The Supreme Court has ruled that concealed carry is in fact covered under the second amendment as a form of protection and crime deterrent. Concealed carry is a very controversial topic, but the idea that it should be legal is the obvious, and most common thought, among many Americans. There are many good reasons why the concealed carry of legalized firearms should be allowed; for example, people would have better protection from criminals, and the fact that crime rates have been proven to decrease. While there are many strong reasons that concealed carry should be lawful, one that serves as an extreme benefit to society would be the notion that being armed would better help to keep people safe from the ones who do not abide by the laws. On connectusfund.org, an article entitled “8 Significant Pros and Cons of Concealed Carry” stated that “This [fact] is further supported by statistics based on a 2000 analysis by John Lott that showed a decrease in murders, rapes and aggressive assaults by 8.5%, 5% and 7%, respectively in states that allow concealed carry.”
The right to have a concealed weapon at work or the right to bear arms for protection no matter where you are is a sensitive and complex situation. This has been the subject of debate between Congress, the National Rifle Associate (NRA), mothers, schools, private business and the list continues to grow. This issue comes on the backs of multiple shootings at schools, business and in lives of people in general. The Second Amendment states the right for people to keep and bear arms.
The potential problem is veterans are separating from the military and cannot not obtain employment in a reasonable amount of time. It is taking veterans six months or more to obtain a job after separating form the military. While many veterans chose to separate after their contract has ended, some are force to leave the military. The military is downsizing, which cause some to leave. In addition, some have been injured, where they have to be release from their military duties.
For advocates of the second amendment, the right to bear arms applies to all Americans for self-protection against dangerous criminals. Criminals will always have access to weapons, therefore citizens need self-protection using firearms. John Lott, in “More Guns, Less Crime,” explains that crime fell by 10 percent in Texas in the year after a law had passed letting citizens carry weapons ( Martin 10). This evidence shows that if more citizens were armed for example, the citizens in Texas, less crime would occur in America. Nevertheless, carrying a concealed gun should not be prohibited from certain places especially with everything going on in society today. The right to carry a concealed gun provides a sense of security, some type of protection if something were to happen. Anything can happen in the blank of an eye and having a concealed gun allows one to feel safe. The law bans concealed weapons carry in a lot of places that a lot of mass shootings occurred at.
