The Slide Rail Agreement lays out with the customer the job specifics, the site-specific engineering plan, proper equipment, and explains that the customer is responsible for the installation and removal. It purpose is so the customer understands what they are doing. Mr. Chilton did not know if anyone from Elliott Construction ever signed this agreement or if it was given to anyone to Elliott Construction, but it was never returned. The slide rail agreement should have been signed when the equipment was dropped off, but it wasn’t because the pre existing relationship between the parties. The corner posts provided for the Elliot lift station project were double rail systems. The purpose of having two rails was to allow someone to install the panels as you dig and push. Mr. Chilton was aware that some of the panels were jammed. Mr. Chilton stated that it was common for the system to be installed properly and then get wracked as you are trying to install it. However, even if the system is wracked and it’s not square, it can be corrected. Final installation it should be 90 degrees. A squaring tool allows end users to check and make sure that the starting panels are all square, allowing the pit to be installed and removed with minimal or zero binding.
