In this assignment, I am going to be defining as well as examining the crimes of both Jamal and possibly Juan. I will also be identifying the victim in this situation. I will be comparing the legal issues for the police department in this scenario. I will then analyze how social diversity played a role in this case as well as discuss the ethical practice of law enforcement in this situation. And finally I will cover the use of technology as a form of evidence.
In this situation Juan, would be charged with the illegal possession of a controlled substance. In the state of Illinois illegal possession of controlled substances is a class 4 felony and has a possible sentence of 1-3 years and a fine of $25,000. This is dependent on the amount as well as the substance itself. In this situation both Juan and Jamal can be charged with battery. This is dependent on who initiated the fight. Normally battery is considered a misdemeanor unless there is a serious injury, if that is the case it gets bumped up to a felony. But to better explain my case I am going to first explain what social responsibility is. Social responsibility is “an ethical framework and suggests that an entity, be it an organization or individual, has an obligation to act for the benefit of society at large. Social responsibility is a duty every individual has to perform to maintain a balance between the economy and the ecosystems.” (Haynes, T.) Juan has many rights as a victim. These include him being informed of his rights. He must also be treated with sensitivity, respect, and dignity. Juan should also receive protection of his privacy. Juan should also receive the opportunity to be heard throughout the criminal justice
