The international attention and response towards human rights concept are improving from time to time. Society, regardless of gender, race, religion, etc. are beginning to believe that as human, we are given a set of rights and obligations which identify our identities as human itself. There are many concepts of human rights emerging after the bland concept of human rights. These new concepts are much more focused and specific based on the identity of the holder of the human rights. Indigenous rights, women’s rights, children’s rights, etc. are the rights specific to the identity of the holders. However, not many people in the world knows about sexual rights. The introduction will also provide the basis and motives of why this research is significant for the development of sexual rights. The second part will provide the information about sexual rights. This part will describe in detail about the points of the sexual rights to enlighten the knowledge of what an individual’s sexual rights are. The second part will also explain the history of the development of sexual rights. The third part of this paper will explain about the theoretical framework which the author will use to understand and predict the cases of sexual rights which will be presented in this research. The fourth part will explain about sexual rights in Indonesia and the cases which violated the sexual rights in Indonesia. And last but not least, the conclusion part will definitely summarize and conclude the entire research.

This Declaration of Sexual Rights was first declared in 1997 in Spain. Then in 1999, the declaration is revised in Hong Kong. Recently in March 2014 the declaration is renewed by the WAS Advisory Council; adding the number of rights from 11 rights into 16 rights. The WAS Declaration of Sexual Rights has been used as the fundamental basis for many other human rights declaration or policy making process. It is important to be noticed that the sexual rights is grounded by the universal declaration of human rights which at present becomes the foundation of numerous laws in several countries.
According to the WAS Declaration of Human Rights, the sixteen sexual rights are:
- The right to equality and non-discrimination: this rights explained that everyone regardless of any differences has the right to receive benefits from this declaration without any exclusion.
