Spider-Man is above the law because his powers make him a very helpful person, his responsibility helps him make good decisions, and his trauma drives him to justify criminals. Spider-Man has abilities and powers that no one else has, therefore he can do a way better job of justifying criminals.
Spiderman started off as Peter Parker, an ordinary, normal human being who got bitten by a genetically modified spider. He wakes up the next morning with incredible powers.
