The fourteenth amendment of the United States is very clear, “All persons born or naturalized in the United States, and subject the jurisdiction thereof, are citizens of the United States and of the state wherein they reside.” The authors of the 14th amendment in 1866 could not have apprehended that Americans, one day would have unauthorized entries into this great land be a criminal offence because no law had every restricted immigration.
