The 4th amendment states that the right to privacy should not by violated by conducting unreasonable searches and seizures. In the hudson v. Palmer case, an inmate named Russel Palmer sued Ted Hudson who was an officer at the Virginia prison. Palmer stated that the officer had conducted a shakedown of his locker and cell in the attempt to find hidden contraband. After the search turned out to be unsuccessful, Officer Hudson, then charged Palmer for destroying state property, as they found a ripped pillow case in his cell. Ted Hudson won the case, as the court stated that the right to privacy does not apply within a prison cell.
The Texas prison systems have many pros and cons that can be easily observed. A beneficial thing about the prison system is that they provide an added level of protection for the public. Every single day there are a variety amounts of criminals who are incarcerated to not only serve their time but to also keep them all under one roof so that they cause no harm to the public. The crime rate in Texas has risen up; from un-resolved homicides to sexual assaults; therefore, when they are incarcerated they will be locked up and the public’s safety will be at ease. Five of prisons in Tennessee are presently over capacity with another eight currently operating over 95% of assigned capacity (Malcolm, 2014.) “When prisons become overcrowded, there is less money and manpower to provide much-needed treatment, educational, and skills-enhancement programs in prison, and inmate-to-staff ratios can grow to levels that are unsafe for prison staff and other prisoners” (Malcolm, 2014, paragraph 11.) I believe a way to fix that issue it through using different reforms to affect the overall percentage all together. As we look at supermax prisons they are used to house many violent offenders to mainly keep them away from all other prisoners in solitary confinement like cells for a long period of time and most of them will never be released. The main issue that Schmalleger and Smykla describe is the fact of a mental illness starting due to supermax confinement and where none previously existed in the past (2015). The issue with that is it could get them out of a supermax prison, which I believe that is completely ridiculous because they were already crazy enough to commit the crime they did to get in there. These staff members will need to take the time to talk and learn about the prisoner because prisoners who endure histories of physical, sexual, and or emotional abuse do not trust anyone and feel worthless. There is a great debate of whether or not the prison system in the United States is positive or negative. The following will briefly highlight the positives, negatives, and possible alternatives for our nation's prison system. First, there is a long list of negatives that the prison system in America brings. The prison system is filled with crime, hate, and negativity almost as much as the free world is.
The growing dilemma of aging prisoners is a very important thing that needs to be fixed. Those prisoners have been in jail for a really long time for crimes that they committed a long time ago. They are old now and they already passed the age of offending and now they would not do anything bad. Not only is it sad and inhumane to keep them there for that long but it also cost a lot of money keeping them there.
Something that I see as a problem that many times leads to people committing more serious crimes, then entering the prison system thus the classification process. As a society inmates are housed for several days and sometimes weeks on crimes that require no sentence at all involving minor crimes. Custody sentences are for punishment, rehabilitation and education, however, there are different views to youth imprisonment. Some critics say if you commit a crime you should take responsibility and jail will give you a ‘short sharp shock’ and you will receive rehabilitation. Whilst some say it is damaging to children and would lead to further reoffending once they are out due to learning crimes off other criminals. Evidence does suggest that children who have more than one risk factor present are more than likely to be involved in criminal activities (Hopkins Burke, 2016 p. 232).
