The James Holmes and the Aurora theatre shooting case. There are many pieces of evidence in this case that could be looked at as someone who committed a premeditated shooting and someone who was in fact insane. Ultimately the insanity plea did not work in James Holmes favor but it did extend what would have already been a long death penalty case. Some key pieces of evidence were highly controversial in the fact that there was arguing over whether or not it should be allowed in court. Ultimately it was allowed and probably helped out the prosecutors more than the defense. The notebook of Holmes is a telling piece of evidence. It, however, can be used for both sides of the case. Reid were shown to the court as evidence. In the series of videos Holmes shares his thoughts and feelings to Dr. Reid. These videos really show that something was very wrong mentally wit James Holmes and could be used by the defense to try to help with the insanity plea. The prosecutors could use this evidence to just prove that he was not insane but did actually have a mental disorder that didn’t affect his ability to know what he was doing was wrong. The book shows James Holmes thought process and planning which shows premeditation. Premeditation is not usually something an insane person is capable of. If the notebook did end up in court I would try to prove that the notebook was full of thing that only an insane person would do and think of trying to convince the jury that James was in fact insane and not normal. I would use the videos of him in his jail cell to show the court that something is wrong with him helping further to prove insanity. The most important argument of my case would be the events earlier in his life. James Holmes did not live a normal childhood. He attempted suicide at a young age. He would see things starting at a young age that (although not actually there but they were in his mind) involved loud noises throughout the night and people fighting and killing each other with weapons and firearms. I think a stronger focus on James Holmes younger years could have helped out the defense a great deal and they didn’t really seem to focus on it that much during the
