The case of Palm Beach County vs Mr. Bryce Zimpfer Mr. Bryce Zimpfer is a 53 years old employee of Palm Beach County, he has been with this employer for 16 years. Mr. Zimpfer is alleging that his employer is in violation of the Age Discrimination in Employment Act 1967 (ADEA). The legal definition of discrimination is an employment decision making or working conditions that are unfairly advantageous (or disadvantageous) to a member or members of one protected group compared to members of another protected group. Now I wasn’t here during that time frame, but from my stint I have observed nothing but a professional associate who would do whatever it takes to make sure Schenker is successful. The ADEA does a lot of good, but it still has its downfalls. Their largest downfall is that the ADEA can place the burden of proof on the employee reporting the age discrimination. Employees must themselves provide proof that they have a prima facie age discrimination case. A prima facie case is a case in which the plaintiff provides adequate evidence that they were discriminated against. The employee must show three things: they are in the protected age group, they are qualified to do the job, and they have been affected by the action taken by the employer.
In the novel “To Kill a Mockingbird” by Harper Lee the character Tom Robinson is a victim of racial discrimination. The setting of the novel is in 1930’s in the state Alabama. There are protections such as The Age Discrimination Act that was passed back in 1967 in order to help the elderly have a fair shot of being hired and keeping their jobs. Overall, this act being in place has been beneficial for citizens over the age of 40. Citizens are able to keep their current jobs and aren 't laid off due to age discrimination laws however,it is still being seen that a lot of jobs make it difficult for older adults to be hired. This is most likely because of the stereotypes that surround older adults. Older adults are considered slow and not technologically savvy compared to the younger workers who are faster at their jobs, are technologically savvy, and can provide the company they are employed at with longevity.
