In Bridger Wells, Nevada in 1885 two characters known as Art Croft and Gil Carter ride into town and enter Darby’s Saloon. When these two entered the environment was repressed due to recent incidents of “cattle-rustling”. The townsfolk suspect that Art and Gil are hustlers. Shortly after a man enters the saloon and announces that a person named Larry Kinkaid which was a rancher has been murdered. Immediately after the townsfolk form a posse to pursue the person responsible for the murder. A towns judge informs the posse that they must bring the suspects back for trial and that the formation of the posse is considered illegal because the sheriff is out of town. They also noticed cattle which are assumed that they are stolen cattle. The illegal posse wakes the three men abruptly then initiated an interrogation with the three men. They are named Donald Martin, Juan Martinez and Alva Hardwicke. During the interrogation David Martin claimed that he purchased the cattle from Kinkaid but received no bill of sale and because of this no one believed David Martin. The posse immediately wanted to have the three men hanged. After this conclusion Juan Martinez tries to escape and they find Kinkaid’s gun. This element is also an infraction of the due process law. Majority of the members are jumping to conclusions and not giving the men an impartial trial and a trial by ones’ peers. Also the town judge said that they must bring the suspects back for a trial. Another reason why this element is posing as an infraction to the due process law is because technically all this evidence is illegally gained since the posse formed is considered illegal. This is important because the three men are supposed to have trial with an impartial or trial by their peers and the evidence was gained illegally. This means that the evidence would have been not
