Legal Issues

There is always risk when conducting a community fair. Who can be liable, what are the policies for conducting a community health fair, and what are the state and federal regulations for community health fairs. Fortunately, there are some federal and state laws that protect health care professionals when volunteering for events such as community fairs. Two state laws that protect health care professionals from malpractice liability are: Charitable Immunity Law and a Good Samaritan Law. The charitable immunity law protects health care professionals from negligent torts when provide nonemergency care for certain charitable organizations. The Good Samaritan Act, protects an individual from liability after providing emergency aid to a person who is injured. Federal laws such as the Volunteer Protection Act (VPA) also protect a physician volunteer from liability. …show more content…

Some things to consider preventing malpractice liability suits:
• A healthcare professional to avoid lawsuit, they have to make sure to take preventative measures by communicating in a clear manner with their patients. Sometimes patients have a hard time understanding, or have a different primary first language.
• In community fairs, health care professionals do not have access to patient medical records. Diagnoses cannot be made, to avoid any malpractice lawsuits, it is very important for physicians to document what the patient has said also what was said in the time of interaction because the patient may provide inconsistent information (Brockway)then accuse the physician of misinformation or
