The writer has a responsibility to the client by promoting and maintaining their well-being which includes her safety, physical, and mental well-being. However, if any aspect of the well-being is violated the writer is required by law to report that a client has abused a child or has threatened to harm self or others (National Association of Social Workers, 1999). In Lesley’s case, the writer has to break confidentially and mandate to report the sexual relationship the client is having with the 25-year-old to Child Protective Services. According to Merriam Webster statutory rape is “the crime of having sex with someone who is younger than an age that is specified by law.” Depending on the state the age limits vary. The sex intercourse could be forced or not forced. As many know it is considered rape if sexual intercourse or contact is within a four year age difference. But statutory rape is more in depth.
A person convicted of statutory rape will be charged with a felony and face a prison sentence of a year or more , as well as fine, although the particular sentence depends on the state in which the defendant is convicted. Where a state has a romeo or juliet mitigation that lowers the crime to a felony when the defendant and a victim are close in age no more than a year in jail maximum.

Predators Target Vulnerable Teenagers Every year, sixteen percent of children ages fourteen to seventeen have been sexually victimized, according to David Finkelhor, Director of Crimes Against Children Research Center (Child Sexual Abuse Statistics). In a true story called “Where Are You Going, Where Have You Been?” and a recent news article, young girls and boys seem to be targeted by much older men, who then abuse them sexually. In both stories, there is a pattern of central themes including the role of parents, vulnerability of teenagers and pre-teens, and the predatory behavior displayed by pedophiles.

Youth sent to adult prisons are at an extreme risk for sexual victimization. According to the National Prison, Rape Elimination Commission and the Prison Rape Elimination Act of 2003 asserted that children are five times more likely to be sexually assaulted in adult prisons than in juvenile facilities, often within the first 48 hours of their incarceration. As many studies have shown keeping kids out of the adult system can be very beneficial. Since 2005, 30 states including Washington D.C. have passed a law the make it more difficult to convict and sentence juveniles as adults.
According to Magnin and Ruback (2013), having an age of consent at 14 or 16 increases the ability to charge an adult with statutory rape with a minor. Some states require that a person is a minor and has a larger age span of 2-4 years between partners in order to charge the older person. In some states, there is no age span legislation. This means that two adolescents of the same age are able to claim statutory rape and one person is treated as the victim. However, Blonna and Carter (2013) state that “traditionally, most states’ original legal wording of definitions of statutory rape defined perpetrators as males and victims as females” (p. 569).

Researcher David Finkelhor states that to consent to sexual activity, one must have the knowledge of sexuality, sexual relationships, ect, as well a sense of authority; children have neither of these aspects and therefore are unable to consent. The effects of child sexual abuse can be traumatic, detrimental, and have long lasting effects that often stretch into adulthood or possibly the victims’ entire life.
