The digital age has taken over the world, integrating itself into all aspects of everyday life. Information that would have taken days to spread can now be done almost instantaneously. On computers, data can be downloaded, replicated, and sent all with perfect accuracy. As a result, controversy has arisen on whether or not it should be legal to resell “used” digital music. Personally, I believe that it should not be legal to resell “used” digital music due to three primary reasons. Firstly, legalization may cause many to misinterpret what such legislation actually means, promoting illegal activities. This doctrine does not cover digital works. Despite this, there are many who cite the first-sale doctrine as the basis of their legal defense. There is a risk of individuals that commit copyright infringement to cite how it is legal to resell “used” digital music, complication the judicial process.
Record labeling companies are the main producers of new music, however if reselling “used” digital misc was legalized, it would result in less people buying from the official distributor and to third parties. This is proven with the legal dispute between Capitol Records and ReDigi due to the fact that music sales would decrease as more people bought music from ReDigi than Capitol Records.
Lastly the marginal cost of producing a copy of a digital file is essentially zero, creating situation where the economy will suffer as a whole. Just like how companies outsource their jobs to places like India because it is cheaper, individuals would prefer to buy music from a redistribute selling music at a lower price. As a result, money does not circulate in the economy as much as it could have had if it was illegal to sell “used” digital music. Although it can be argued that job outsourcing creates wages that the workers can funnel back into the United States economy, but the products generated benefit both the consumers and the producers.
