Although the Articles of Confederation served a great purpose and had numerous advantages and strengths, it also contained many weaknesses with some flaws. One of the weaknesses is that this agreement could not enforce laws or have the power to tax the people of the colony. Along with this, the government could also not allow each of he states to continue to follow those laws. There was also no national army or navy, no national courts, no solid leadership or power in a position to take charge, and there was only one vote for each state no matter what the size of the state is. The articles of Confederation were considered a failure but still provided a huge stepping stone for the next constitution of the United States. The first thing that the articles of confederation did wrong was leave out provisions for an executive branch. This left the states without the ability to enforce laws
The Articles of Confederation were not the ideal set of laws that the founding fathers intended. They had their flaws, but they also contain a few laws that fixed some current problems of the country. The problems that faced the new nation were, the need for unification and preservation of this unification of the states, the rules emplaced on expansion and settlement of western lands, and it set up a economy, that was vital to the country. The states had just won the revolutionary war by coming together to fight the British, and the Articles of Confederation made sure that this unification was official and permanent.
As it applies to the Articles of Confederation there were many weaknesses in the way it went about governing the United States. For one, the loose federation of the states was too weak to act as a foundation to be considered or act as a central government. In addition the state legislatures had too much power and in turn had the ability to influence economic issues of all kinds. This strong legislature is the same one that allowed for mob ruling and actions by debtors. The Articles of confederation were also weak because the required congress to have all 13 colonies in agreement when a new tax was to be passed.
Following the Revolutionary War, America had just gained independance from Great Britain and needed to form a new government. The Articles of Confederation were established as an attempt to create a government that was unlike Britain’s. Unfortunately, the Articles of Confederation had several weaknesses. When in the process of repairing those weaknesses, the Federalists and the Anti-federalists formed. The Articles of Confederation were very weak as well as useless to America and because of this, the Federalists and the Anti-Federalists could not agree on a new type of government.
The new government, the Constitution, is now able to enforces taxes, which allowed money to come in and the government was able to pay off their debt. One other weakness of the articles was that it gave all power to only one house of representative from each state, the constitution try to solve this matter that creating three separate branches of power, the Legislative branch, Executive branch, and the Judiciary branch, allowing the power to be more divided. Representation was another problem in under the Articles of Confederation because a big state like Massachusetts and a small state like New Jersey both have the same amount of representatives, the Constitution made a compromise by forming two house in Congress the Senate, where each state get equal representation, and the House of Representatives, where each state is represented by the population of the state. The Constitution also fixed the problem of passing a law; under the Articles of Confederation, laws can only be passed if 9 out of 13 representatives agrees on the law because of this not much laws were passed, now under the Constitution only 51 percent of the votes to pass the law. The Articles of Confederation was an agreement among the thirteen original states of the United States that served as the first constitution. The Articles had first been introduced by Richard Henry Lee in the Second Continental Congress. Although the Articles of Confederation has made its contributions throughout history, the Articles, however, did not last very long and had been proven inadequate from the very start. In 1777, after the American Revolution had ended, the new United States of America adopted the Articles of Confederation as the new central government. The Articles made the government weak, powerless, and vulnerable out of fear for tyranny. This system had many flaws and created a lack of unity between the states. As a result, the Constitution of the United States was developed in 1789 to solve many of the problems that arose from the Articles. This new system re-constructed the government into three branches and created a system of checks and balances to prevent the government from becoming corrupt.
And lastly they just did not give the government enough power. When the Articles of Confederation came into play, they did not work as planned. With them, there was not really an executive branch. There also was not a judicial branch of government. All there was was a legislative branch, which was the Congress.
The Articles of Confederation was the first constitution of United States in November 1777. There were many weaknesses of the Articles of Confederation. There was no national executive i.e. president, and no national judiciary. This confederation did not give national government any power of direct taxation. Before making any changes to the Article, 9 out of 13 states had to approve the law before it was passed.
They already had the Articles of Confederation as a model for the nation. Unfortunately, the Articles of Confederation did not give the Federal government enough authority, leaving the power instead with the states. Although there were some positives of the Articles, such as the Northwest Ordinance, which created new states in the Union, there were also some negatives, such how the, "Articles had limited powers: it had no power to tax, it could not compel the states to contribute to financing its operations," as explained by historian Jon Gjerde. Taxes are meant to fund the development or building of something that will help the country. The Articles of Confederation stated that the government would ask for a voluntary donation from the states, who would pay 1/4 of the times that they were supposed to, while the government couldn’t enforce this policy. If this continued, then America would have little to no money to fund anything expensive, such as a war or an exploration of land. Another flaw with the Articles of Confederation, was that, "It had no executive branch and no separate judiciary; instead, it relied on a legislature in which each state had equal representation”.
There were many flaws with the Articles of Confederation for example there was not an executive branch. In article two section one of the Constitution they made it so the President had executive power along with a Vice President. Another issue was the fact that there were not any federal courts. This was changed in article three section one and two, and they stated that the judicial power will be held by one supreme court with inferior courts. There also was no power to tax or regulate commerce.
The constitution was able to address the problems with the Articles of Confederation. The Constitution created a Federalist government with a strong central government at the national level and weaker governments at state and local levels. It gave the national government the power to tax, draft troops, control interstate commerce, etc. Also because of the failure of the Articles of Confederation the Bill of Rights was established. With the Bill of rights in place and all the news laws into order the constitution was able to repair the failure that the Articles of Confederation
The Articles of Confederation were a document seen as the “first” constitution of the United States. This document granted the new national government power to control the military, declare war, and create treaties between the states. However, the Articles had holes in it considering the government did not have the power to tax, create laws without at least nine states’ approval, or change the Articles of Confederation without a unanimous vote. This means that the country soon fell into debt and petty arguments between state, the new government had no control. It was time for a change.
