According to James Madison, “Congress shall make no law…. abridging the freedom of speech….” The First Amendment was written in 1789 and it has worked for decades. However, after the introduction of internet in human’s daily life, the society is now challenged with the idea of government’s role in monitoring the internet content. With situations that include threats, substance unsuitable for children, and online malicious behavior, there is a need for government’s regulation on people’s speech.

Arguments over the First Amendment and its guarantee of a freedom of speech and expression have existed since the dawn of the country, and although these discussions often happen as a result of a major policy changes or violent events involving both sides of the political spectrum, I personally feel as if the amendment should be looked in another light. If you look back to the founding of our country you can see that we have fought war after war to protect are ability to have a first amendment right. Wouldn’t you say that it is a pretty important issue if we are willing to send millions of men and women to fight, and potentially die, for its cause? The first amendment is important because without it there are ghastly consequences. Just look at countries that don’t have the option to speak freely, such as China or North Korea. In these places they are people who constantly have to live in fear about saying the wrong thing to the wrong person.
A further consideration that must be taken into account while evaluating this case is that of time, place, and manner restrictions. Such restrictions are a sort of measuring stick when it comes to these types of freedom of speech issues. If a group or individual does not comply with time, place, and manner restrictions, their actions are no longer protected by the First Amendment. Meanwhile, if these restrictions are adhered to, a party has the constitutional right to voice their viewpoints.

I think what I have learned in writing and gathering research for this paper is that freedom of speech is not bad, at all. It was our Founding Fathers attempting to make – to some degree – citizens equal in voice to their government and demonstrating that every man from the elected official to the one that cast a vote to elect him is created equally. If no one dared to say their opinions, then it had become a dictatorship where only one opinion on how society and the country should work had been the “right”. If people dared to express their opinions, they will help improving the society one lives.
