Jodi Arias was on trial for the death of Travis Alexander, an ex-boyfriend, who was killed in a ruthless manner. In the early stages, Jodi Arias denied visiting Alexander’s residence around the time of death and appeared confident that she would win the trial. Then she changed her story as new physical evidence placed her with the victim shortly before his death. This type of behavior does not look good for her. Right of the bat, the public defender should have pushed for advising Jodi to plead the fifth and not to testify. I believe that is the only way to salvage some of the damages that are already done by Jodi Arias and force the prosecutors to prove beyond a reasonable doubt to the jurors. The defense attorney brought in an expert witness to testify that Jodi is suffering from posttraumatic distress of the abuses by Alexander. Her claim of memory loss makes her an unreliable testifier, since she cannot recollect what had happened. In addition, she is not a credible witness because she have lied and changed her story to the investigators. Jodi’s did not give consistent statements to the investigators. If the public defender allows her to testify, the fact that she lied and changed her story will be brought up during cross-examination. At that moment, her credibility as a testifier will be ruined, as well as her strategy to play the victim. She would be a terrible witness to put on the stand. The public defender should have told her to plead the Fifth, them the prosecutor would have to prove to the jurors beyond a reasonable doubt that Jodi killed Alexander. I believe sentencing individuals to prison is only good for punishing and taking away their freedom. In my opinion, prison does not rehabilitate individuals, but makes offenders more likely to reoffend. In addition, the deterrence purpose of sentencing only works in theory with little use in reality. In theory, deterrence works in preventing rational from committing crime because they understand there will be punishments when they are caught. A rational person would think about the possible punishments before they commit any crime, however, individuals that commit crime in the real world are irrational. Since individuals that feel the need to commit crime never believe they will be caught, and they do not even consider punishments as a possibility. Travis Alexander was murdered in an especially heinous and cruel matter, which are aggravated factors that could affect the sentencing. With the aggravating circumstances, it is necessary to punish Jodi Arias harshly and sentence her to death for the brutal murder of Travis
