The 14th amendment passed by Congress and our class express pros and cons that affect the United States heavily. The class amendment has a chance of being ratified if some articles/sections are changed. The South would be deeply affected if the amendment was to be passed. IV. Addressing the opposition A. Argument 1 The Plaintiff has argued that this regulation is in best interest for the public and provides security for the society as a whole. They want the regulation to be considered Constitutional because it was voted on by the majority and therefore, it is in the best interest of the community and should therefore be enacted. This argument does not speak to the constitutional issue of the case. The Supreme Court’s main objective is to protect individuals and minorities from oppressive government.

One example being if modern punishments used today, like extended use of solitary confinement and use of lethal injections to kill them violate the amendment (Stevenson et al). Some believe that because both of these methods might cause both physical and mental health issues, it should violate because of the belief that if the punishments “are deliberately designed to inflict pain for pain’s sake, and are objectively harsher than punishments permissible in 1791” (Stinneford), then they must go under the cruel and unusual category. There are some flaws that could be considered for this belief, though, like for cruel punishments that were still allowed in the 1800s can be easily compared to some used today. The 8th Amendment is stated as simply as this: “Excessive bail shall not be required, nor excessive fins imposed, nor cruel and unusual punishments inflicted.” We do know some things about the history of the phrase “cruel and unusual punishments”. In 169, a full century before the ratification of the United States Constitution, England adopted the Bill of Rights that prohibited “cruell and unusuall punishments”. In 1776, George Mason included a prohibition of cruel and unusual punishments in the Declaration of Rights he drafted for he Commonwealth of Virginia. In 1791, the same prohibition became the central component of the 8th Amendment to the United States Constitution.
The Eighth Amendment was created to prohibit cruel punishments that the colonists would receive from the British. The British brought colonists over to an unfair trial and then received punishment that sometimes would be death. The writers of the wanted to make sure that the colonists received the fair trial and fair punishment they deserve. The Eight Amendment was ratified in December 5, 1791 as a part of the Bill of Rights. The Eighth Amendment has not been changed since the ratification in 1791.

The constitution was written because the people wanted to create a nation in which states can work together. The preamble also helps the constitution in the way that it establish justice like making laws and setting up courts that are fair and a jury system. Domestic tranquility is keeping peace within the countries like for example the national guard and the federal marshals which the preamble states.
6th Amendment I personally find that out of all the amendments the most important one is the 6th amendment. Reason being that it is crucial in aiding the judicial process from wrongly persecuting innocent people and it allows our democratic process to continue without preventing innocent people for taking the fall while punishing those who harm it. It keeps justice in check, keeping laws in line and rulings to be fair. The 6th amendment helps the defendants have an attorney when they are unable to afford one.
In the late 1700’s, James Madison wrote the first Ten Amendments that are listed in the United States Constitution. The Bill of Rights were written to ensure American citizens that they have freedoms and rights that the government can 't infringe. Out of the Ten Amendments, I believe that the First and Eighth Amendment are the most significant. The First Amendment grants us freedom of speech, religion, press, petition, and for people to assemble peaceably.
