Because of the states having more power over Congress, the states did not focus on the needs of the whole country but only cared for their own state and what is best for their people. The United States has worked under two constitutions. Articles of Confederation was the first constitution in our nation. It was in effect from March 1st, 1781, after Maryland ratified it. Articles of Confederation was replaced by The Constitution on June 21, 1788, which was ratified by New Hampshire. 10/23/14 Sarah LeBoeuf POLS 1113 Dr. George Black The Constitutional Convention The Constitutional Convention took place secretly in place in Philadelphia, Pennsylvania from May 25 to September 17, 1787. Some well-known delegates who attended include George Washington, Benjamin Franklin, Alexander Hamilton, and James Madison. After much discussion, the 55 delegates decided to completely new articles rather than attempt to revise the Articles of Confederation.
The Bill of Rights was passed by congress on September 25, 1789 and was ratified on December 15 , 1791. James Madison and George Manson contributed to the bill rights. In the website, “Bill of Rights Institute,” the “Bill of Rights of The United States of America (1791)” explains the history of the Bill of Rights. At first 17 amendments were agreed on at the house but only 12 out of those 17 were approved. From there , only 10 were passed after being sent to the rest of the states.

These past few years have been some troubling ones. Since the revolution and the ratification of the Articles of Confederation our country has been in a state of limbo. For every step forward our country attempts to make, we end up taking a giant leap back to where we began. Recently, our founding-fathers have taken part in a convention and have began discussing the idea of a new constitution- a new way of structuring our government. This constitution, however, has been lacking in support from some very crucial states due to the lack of a Bill of Rights, which would address the individual rights of a citizen.
The first amendment guarantees five basic freedoms to the American citizens. These freedoms are of speech, press, petition, assembly and religion. As all the amendments, the first amendment is intended for use in situations with the government. The first amendment was written by James Madison and was sent to the states to be ratified on September 25, 1789 along with the twelve proposals for the bill of rights.. Then it was officially adopted on December 15, 1791.

The notion of a living Constitution has greatly developed the American system. It has brought innovative perspectives on how the courts should be responding to constitutional situations. As well, it creates a basis for society to grow through means of acceptance and progressive viewpoints. The constitution should not be used to fit policy outcomes, and that would be the intent originalists seem to push for. Furthermore, there are two distinct reasons why the argument for the living constitution is stronger then the argument for the original intent.
