Policy Analysis: Megan’s Law Sexual violence, particularly against children, is a significant issue all around the world. In the early 1990’s in the United States, there were multiple well-publicized cases of sexual violence against children. From kidnappings, to rapes, and everything in between, violence was being committed against children and something needed to be done about it. In 1996, Megan’s Law was passed in response to the sexual assault and death of Megan Kanka, a seven-year-old from New Jersey (Corrigan, 2006).
On July 29, 1994, New Jersey resident Megan Kanka was lured into the home of Jesse Timmendequas, a convicted sex offender, with promises of seeing a puppy (Corrigan, 2006). Once she entered his house, she was raped twice, strangled with a belt, and suffocated with a bag (Corrigan, 2006). Timmendequas was arrested soon after and confessed to this crime (Corrigan, 2006). This event outraged Kanka's parents and the surrounding community (Corrigan, 2006). They used this tragic death to create Megan's Law as an addition to the Jacob Wetterling Crimes against Children Violent Offender Registration Act, which required sex offenders to register within their counties (Welchans, 2005).

Dealing with sexual offenders is not always an easy task to do. Many of the times, the offender will either cooperate or not cooperate. That being said, ATSA has set up a list of regulations that employees should considered. The one I thought were interesting was the fact that motivation inside of the facility and outside is crucial when it comes to the overall treatment of the offender (“ATSA Practice Guidelines and Ethics Order Form,” 2015). If, for example, the treatment is neglectful from the inside of the facility and no support is given by those at home, there’s a high chance that the offender will become an habitual criminal.

Bush signed The Protect Act, which allowed the authorities to punish anyone in some kind of way who committed crimes against children. All 50 states, and even other parts of the world had plans involving Amber Alert around the year of 2009. Canada also decided to join in on Amber Alert and the idea continued to grow across the Mexico.
It made a few changes to the current Megan’s Law, like changing how offenders should register and where they were able to register (Harris, et al., 2009). One of the most notable changes that the act proposed was assigning sexual offenders to a tier ranking system, either Tier I, Tier II, or Tier III based on the severity of their conviction. Tier I is the lesser of the classifications, in which someone who was charged with public indecency, an attempt to commit specific federal crimes, or various other charges could be classified as. Tier I offenders are required to register their offender status with local law enforcement agencies for fifteen years, unless they have a clean record, which would then be brought down to ten years. Tier II offenders are classified to be slightly more serious than Tier I, because the nature of offenses for Tier II offenders include possession or distribution or child pornography, soliciting a minor for prostitution, or various other sexual acts including minors.
Additionally, California has a law that allows citizens access to a CD-ROM with detailed information on sex offenders living in the state. The Pam Lyncher Sexual Offender Tracking and Identification Act, signed into law by President Clinton in 1996, called for a national registry of sex offenders, which allows state officials to submit queries and determine whether a job applicant at a day-care center is a registered sex offender in any of the participating states. Overall, communities have the right to be informed about the presence of sex offenders and take measures to protect themselves, such as avoiding contact with the offender or limiting their access to certain areas. Earlier this month, a “sexting ring” at Canon City High School in Colorado was uncovered by school authorities. Involved were minors and legal adults, who had scandalist pictures and images of naked minors. This has brought upon the question of, “How do you prosecute and punish those involved in these acts?” Those responsible for these acts must take the punishment which they are served when the time comes. The judge is gathering the information and having the ones involved questioned.

Some risk factors for drug abuse found in sex offenders include; brain damage, HIV, AIDS, and other sexual transmitted diseases, lung disease and cancer. The use of a substance can have a great impact on the offender. The offender can develop many problems with substance abuse and that could greatly affect their self mentally and physically. Substance abuse can greatly affect the offender’s family.

In addressing the issue of registries there are two issues that stand out on the “positive/pro” side. First the most obvious, I can know where all the sex offender are around me, which we give me the ability to tell my children where and whom to stay away from. Second, the government/officials get to look good while giving the community a sense that they are somehow safer. I believe these two factors are hollow and in actuality accomplish little if anything at all. One of things that I find most disturbing regarding sex offender registration is that all sex offenders are basically treated the same, regardless of their circumstances, crimes, and levels of dangerousness.

As a result, society must become more aware of female sexual perpetrators, as many incidents of females assaulting both young men and women have gone unreported for some time.
