If a natural disaster strikes my area and the power is out for weeks, one of the limitations would be that the people would not feel that safe. Security wouldn't be enforced and since there is no security, there could be several possibilities of theft. Another limitation would be searches for any and everything. The fourth amendment protects citizens from unlawful search and seizure. In order for a search and seizure to happen the police have to have evidence in order to get a warrant which allows them to search the citizens luggage, house, etc. In some cases the government may go to far, or invade privacy of others, but in this case the government didn’t go to far and this is proven in DLKs case, thermal imager, and heat image. If America did away with the fourth Amendment there would not be any crime because the police will be able to arrest anyone without probable cause. The police would have such much power that people will be afraid to even drive through a stop sign.
The First Amendment is the most important, because of freedom of religion and freedom of speech. Many people think that the fourth amendment is the most important. They think this, because it is important for a person to be able to tell policemen “No” if they ask you if they could search your car or your house. I believe that the fourth amendment is really important, but you wouldn’t be able to tell the policemen “No” if you didn’t have freedom of speech. In the scenario, it is important to remember that the employer is a government entity and the Fourth Amendment was originally designed to limit government authority as it applies to unreasonable searches and seizures (Hall, 2014). You would not be able to make a strong argument that the government violated the Fourth Amendment in this scenario. The property, whether it is a laptop, cell phone, or tablet, belongs to the government. Government entities have policies that employees must read and sign specifically acknowledging there is no expectation of privacy on these devices owned by the government.
Espionage and the Fourth Amendment are not compatible especially when people get accused for no legitimate reason. After the September 11 terrorist attack on the Twin Towers in New York. George W. Bush issued more policies to expand espionage agencies to ensure that future terrorist attacks can be prevented. Some people might argue that “preventing the loss of American lives requires some restriction of civil liberties” but other people say that “the war on terrorism is different from traditional wars and thus requires that government officials exercise special care to maintain civil liberties” (Espionage and Intelligence Gathering 114). Having civil liberties is one of the few rights that American citizens can have.
The whole point of the Fourth Amendment is not to completely stop the police, because the amendment can be waived if an officer has a warrant, or a person’s consent. The Fourth Amendment states that generally a search or seizure is illegal unless there is a warrant, or special circumstances. Technically stating that a citizen is protected by the Fourth Amendment, until a government employee gets a warrant, and then they can invade a citizen’s privacy. Also people state that the FISA Court’s warrants are constitutional, but the NSA’s surveillance is unconstitutional. Even though people do not like the NSA’s surveillance, the NSA is legal because the FISA Court that the people did not mind makes it legal.
The fourth amendment can be beneficial but, it can also to some U.S. citizens be invasion of privacy. The fourth amendment states “The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated,” some U.S. citizens believe that Law Enforcement, the Government and the NSA are violating the required guidelines of the Fourth Amendment. The NSA is conducted a mass U.S. surveillance not to believe specific individuals may be engaging in terrorist activity, but instead to believe all of us may be engaging in such activity. The writs of assistance showed the colonists they needed a government that had valid reasons to search them or seize their property. Once the colonists had their own government, the ratified the Fourth Amendment to give themselves these protections. Without the Fourth Amendment today there would be much more concern about police biased and prejudice.
