Independent But Influenced In the past, the Supreme Court has been viewed as an institute that is implied to be separate from politics. This means that the Supreme Court should not be influenced by political ideas and situations. In this essay, the truth of this statement will be evaluated and the idea of the Supreme Court being influenced by politics over the years will be clarified.
To begin, the Supreme Court has been viewed as independent. But what does this mean? To clarify, one must fully understand what the Supreme Court is. The Supreme Court is not the judicial branch itself, but rather the highest court in the branch while the smaller courts, for example city and state courts, lie beneath the Supreme Court. This is much like a king with his fellow courtsmen. The job of the Supreme Court, as listed in article three of the Constitution, is quite easy to understand, however to this day is still being evaluated for interpretation. Judicial independence is the concept of the need for the judicial branch to be kept separate from politics and even the other two branches of government. The Supreme Court is the only branch of government that should play a role in politics. That is why it is considered to be independent and separated from political situations and opinions. Judicial Independence is also a key in the concept of separation of powers.
