John Giglio was charged with passing forged money orders and sentenced to five years imprisonment. During the appeal, Giglio counsel discovered new evidence representing that the prosecutors had failed to reveal a promise made to its “key witness” that he wouldn’t be prosecuted if he testified for the government. The Court granted a certiorari to determine whether the evidence not revealed would require a retrial under the due process standards Napue v. Illinoi, 360 U.S. 264 (1959), and Brady v. Maryland, 373 U.S. 83 (1963). Evidence showed at trial, representatives at Manufacturers Hanover Trust Co. learned that Robert Taliento, key witness and co-conspirator, was a banker teller and also had cashed several forged money orders. He confessed to providing Giglio with a customer’s bank signature card used by John Giglio to forge $2,300 in money orders.
The Ethics of Fred Zain Fred Zain was a forensic lab technician that worked for both the states of West Virginia and Texas. A man who did a job he was severely under qualified for, for ten years, and who was thought to be a start asset in his line of work. Fred Zain had testified in countless cases, presenting himself well and appeared to know his trade so well that no one in the courtroom questioned the lab results obtained by Zain. It is very well known that his actions in court are viewed as unethical by today’s standards. In his time of employment, Fred Zain acquired a lengthy rap sheet of tampering and falsifying evidence, false convictions.

The prosecutor's dilemma refers to the fact the District Attorneys and prosecutors are elected officials who must appeal to their constituents and the public ideals so that they can continue being elected; however, this sometimes interferes with the official role of the District Attorney which is to seek justice in the courtroom by the rules of the law. Nifong was running for District Attorney, and knew that if he prosecuted those lacrosse players in such a high-profile case, this would likely be the edge he needed to win his election. In attempt to appeal to his voters, Nifong stretched the truth and withheld evidence as to bolster his case and make him look stronger. Not to mention, if he had brought the lab findings forward, he would have had to admit that he had been wrong throughout the entire case thus far,, which would look bad politically. So, rather than admitting he was wrong, Nifong pursued the case even further to further his political interests, which detracted from his more important goal of seeking justice and truth.

This article on ethics was really interesting and a dilemma that is prevalent within criminal justice. In the article Dr. Steven Davis recognized that students cheating in high school increased by 20% in the 1940 to 75% today. Davis stated, "If students lack ethics in high school and college, then there should be little surprise that they lack ethics in their careers. (2008). " This observation by Davis holds some value, because individuals that is willing to cheat to get ahead, definitely has no problem crossing ethical lines, because in their mind the wrong is acceptable, just as it was when they cheated.

The Buffalo Creek Disaster was a man-made disaster that occurred in February 1972. The Buffalo Creek Mining Company’s coal waste refuse pile collapsed, leaving over 125 people dead and 4,000 people mentally distraught. The Arnold & Porter law firm was reached out to by survivors for help and Gerald M. Stern was appointed as the lawyer for the case, who eventually won $13.5 million for the survivors.
