When thirteen hundred people die from a single cause every day in the United States, there needs to be something drastic done. Cigarettes along with second hand smoke kills more than five-hundred and 20 thousand deaths per year in the United States; something needs to change. As technology advances and the medical science field expands, technology can be used to improve almost every quality of life, but who would’ve thought that it could be applied to a billion dollar industry that has been static for the past two decades. “The modern electronic cigarette was first invented in the year 2000 by a chinese pharmacist by the name of Hon Lik” (Hemphill 2). E-cigarettes use a piezoelectric ultrasound-emitting element to vaporize a nicotine infused, propylene glycol based solution. The FDA has regulation over all products “derived from tobacco,” which inexplicably allows the FDA to regulate E-cigarettes due to that fact that the product contains nicotine. Under that new law, implemented in 2009, the FDA labeled many E-cig devices as unapproved drug/medical device. This designation allowed the FDA to more strictly regulate the availability of these products. After this action, a manufacturer, Sottera, challenged the FDA in court almost a year later. The U.S. Circuit Court was in favor of the manufacturer, thus changing the FDA’s authority to regulate E-cigarettes as drug/medical devices. There is a fairly large complication presenting itself when it come down to how and in which ways to regulate the sales and use of E-cigarettes.
