Your honor, it is so hard to think of a resolution to this situation considering how many ‘what-if’s’ there are or could be. All I can hear in my head is April saying, “It’s okay, accidents happen”. But the truth is, this accident could have been prevented. Thomas Burns made the choices that lead to the accident. His choices of getting in that boat, driving under the influence, and going 40 MPH on a very dangerous lake. No amount of hours in jail or restrictions will bring our loving April back, and he is already being forced to live with his actions. I feel it is also worthy to consider that his choices not only took April’s life but put three more lives in immediate danger, two of which were seriously injured. I believe these choices and neglectful acts should be thought of and considered in his sentence. I feel it would be fair to follow similar DUI cases concerning the reckless actions and number of people involved.
