Timothy Cole was convicted of Aggravated Sexual Assault on September 17th 1998. Timothy Cole was a 26-year-old young man who used to attend Texas Tech as a business major. While he attended Texas Tech, the police was looking for a serial rapist known as the “Tech Rapist”.
It was March 24th 1985 when the crime that wrongfully convicted Mr. Cole occurred. It was a dark night when 24-year-old Texas Tech student Michele Mallin parked her car near a church to get to her apartment. Suddenly an African American man ask Michele if she could help him jumpstart his car. Michele said that she did not have jumpstart cables; the black man unexpectedly pointed a knife to her throat, Michele bit him but the man forced her to lay down in the car while he moved to the driver’s seat. One of the detectives investigating the crime talked to Timothy Cole in a parking lot near the crime scene. Since Timothy was black and close to the crime scene she thought that Colin could be responsible for the rape.
The detective followed Cole and took a Polaroid picture of him. Latter the detective showed the picture of five suspects including Cole. Cole’s picture was unique due to two facts (1) he was the only one facing the camera with and (2) he was the only one with a Polaroid picture. Mallin identified Colin as her aggressor.
The next day the police conducted a line-up and Mallin pointed Collin as her aggressor one more time. Based on Mallin’s identification, Cole was arrested and charged with aggravated sexual assault.
The judge was terribly unfair, he did not listen to any of the logical facts the defense attorney presented to protect Colin from injustice. After an unfair trial In September 17th 1986 Colin was sentenced to 25 years in prison. It was really sad due to the fact that Timothy Collin was only 26 years
