“Brokeback Mountain” is a love story between two people, Jack and Ennis, who come together while herding sheep one summer on Brokeback Mountain. One night, their emotions overtake them and they find themselves entangled in an embrace that would lead them to hide their feelings for one another to the outside world. Jack is a character that longs for Ennis and creates this illusion that one day they would be able to live on a ranch together while tending to the animals. However, Ennis has his foot set on the ground and understands that with the society they live in, being together would not result well for either of them. While spending their time on Brokeback Mountain, Jack and Ennis find themselves having sex in the open space, when they believe no one is watching them. However, to Jack’s surprise, he later finds out that Joe Aguirre – the man who hired them, is watching them from afar and seeing this interaction between the two men. This invasion of privacy can be argued both ways, being that the mountain and open field is open property and thus, there can be no invasion. However, it can also be argued that the invasion of privacy comes from observing the two men during an intimate moment, when they believe no one is watching them. In Loving v. Virginia, this idea of property also comes to mind when discussing the invasion of privacy when police officers entered their home and arrested Richard Loving while in bed with his wife. In the film Loving, it can also be seen how Richard creates this home for him and his family as a representation of their privacy and property – something that belongs only to them. In a similar manner, Jack and Ennis felt like Brokeback Mountain was a place that belonged only to them, it was the place that they would always go back to when talking about a time they were both
