For example being on a plane and yelling bomb or being in a crowded room and yelling fire when there is no bomb or fire. Yelling those things will cause people to panic and can cause problems and might injure people. Everything else should be protected under the first amendment. A quote from Benjamin Franklin, “Without Freedom of Thought, there can be no such Thing as Wisdom; and no such Thing as publick Liberty, without Freedom of Speech; which is the Right of every Man, as far as by it, he does not hurt or control the Right of another: And this is the only Check it ought to suffer, and the only Bounds it ought
The 1st amendment is fundamental in a democracy, it gives each individual their opinion about a certain subject and gives the people the "power" to speak out when they find something wrong. For example, they can speak what they find wrong with our Representatives, without the retaliation or censorship of the government. You might think that you can go down the street and say whatever you like without anybody telling you can't. Hold your horse right there be aware that you can say what you want but there is certain things that the 1st amendment doesn't cover. The Supreme Court has some cases where it decided where the 1st amendment was appropriate and where it wasn't.
In 1789, thirty-eight men who helped shape America into what it is now signed the Constitution of The United States of America, approving it’s message and the rights, or Amendments, listed within it. The first Amendment listed in the Constitution is the right of freedom of speech, the press, to peaceably assemble, and religion. However, in current times, citizens are challenging this Amendment by censoring the media, books, T.V shows, and movies. Why is it that people are doing this now, after nearly 230 years? Some people believe that certain information and ideas must be withheld from certain minorities and age groups, and few others believe that some ideas must be censored to everybody.
The twenty-first amendment expresses the greatest amount of importance in the constitution because it repeals another amendment and assists in creating a big picture model of freedom in the US and the world. In section one of the twenty-first amendment the eighteenth amendment is repealed, ending the prohibition of alcohol in the US. The ratification of the eighteenth amendment start a slew of problems for the US with citizens creating their own alcohol illegally which in turn increased crime and gang activity. However, through the ratification of the twenty-first amendment the government was allowed to gain a better control on crime and the distribution of alcohol through federal, state, and local laws. The twenty-first amendment allows each
Introduction The People v. Larry Flynt ‘The People v. Larry Flynt’ is a docudrama that chronicles the life and exploits of Larry Flynt and his pornographic publication, ‘Hustler.’ Hustler originally began as a newsletter to attract patrons to Flynt’s Hustler Go-Go club with nude photos of the women who worked there. This newsletter evolves into Hustler Magazine, which over time gains a widespread distribution after acquiring and publishing nude photos of Jackie Kennedy Onassis, former First Lady. Flynt is sued for pandering obscenity and engaging in organised crime.
The first amendment main purpose is to limit the power of the congress. It restricts them. The same limit however does not apply to us. We are allowed to express yourself without interference or constraint by the government but the government can limit both the content of speech and the ability to engage in speech as long as the government has a “substantial justification.”
The people are giving up some of their right so the government will protect them. The first amendment is “freedom of speech, religion, press, assembly and petition” The first amendment is similar to the social contract because in a way the government is promising to protect you in exchange for some of your rights.
Why is the first amendment the most important, people may ask? It is important because it gives people the freedom of religion, the freedom of speech, and the right to peacefully assemble and petition the government. There is a boiling pot in the America so everybody is different , and with different mixes from different places. People may say what they want because of their opinion. If they feel like they need to say their words louder than others they can do that to, well now i’m going to explain to how the first amendment is the most important .
The First Amendment states, “Congress shall make no law abridging the freedom of speech.” Freedom of Speech helps those who need help and can ask the public without worry of getting in trouble. This amendment was included in the Constitution because now people e the right to advertise their work to others and have protests to things that they believe is right for the country. The amendments were important to the framers of the Constitution. The Freedom of Speech was important to the framers because of, “its diffusion of liberal sentiments on the administration of Governments.”
I would give them the 1st amendment because they can say anything they want without being killed or punished. Also they can have meetings about what they want to do like for example get rid of the “Great Leader”. They can do petitions like for example “equality for women” so they can have fair rights. It would be good for them to talk to the government and see what they can decide or negotiate. If they had freedom of religion they can praise to who every they want which is fair and they won’t be forced to believe in someone but
Even though the Westboro Baptist Church offends many people with their picketing and other demonstrations, I believe that the first amendment to the U.S. Constitution should continue to protect their right of performing these acts for two reasons. One, the first amendment already protects, in a sense, some of the actions the church performs, for example, the picketing of high school graduations and claiming perverts ran the schools. As unbelievable as it may sound, the first amendment allows them to say particular things like this because of what is known as the Sullivan Rule, which is a court guideline protecting inaccurate and harmful declarations against public officials as long as the claims were not known to be false at the time they
In 2007, after many appeals this case went on to the Supreme Court. On June 25th, 2007, the Supreme Court had a majority vote ruling for the principal and the school as they have the right to suspend a student who is demonstrating “pro-drug messages” which go against the school 's message (Morse). Frederick 's first amendment was not broken as his freedom of speech was limited at school. Marijuana at the time was an illegal substance, and due to that, Frederick was promoting something illegal.
Here I will tell you the key ideas about the first Amendment. The main key ideas are; Freedom of speech, freedom of religion, and freedom of Press. “Congress shall make no law… abridging the freedom of speech.” This means that the Government can not make a law that can block and or can take away people's right to freedom of speech.
America is a country made of immigrants and their children. The First Amendment is so important because it guarantees that people won’t be arrested by the government for customs they have. Religion is the backbone of almost every major culture and civilization in the world. Having religious freedom means that no matter what god(s) you worship, no one has the right pursue legal action against you. This also means that the United States cannot establish a national religion.
We all have heard of the Bill of Rights because they outline what we as American citizens are entitled to and what the government can’t control. The Constitution lays out the building blocks of the United States of America and the first ten amendments are what are known as the Bill of Rights. Having the Bill of Rights in our Constitution plays a big role on how government power is distributed. Our Founders wanted us to have as much freedom as possible without causing chaos. Instead of having all power and freedom rely on one government, we decided to break it down.
