Facts Jesse Gilbert was charged with armed robbery and the murder of a police officer. Gilbert would not answer questions about the robbery charge without a lawyer, but later answered questions about a robbery in which the robber, supposedly Gilbert, used a handwritten note demanding the money. He gave the police handwriting samples, which were later admitted into evidence. The police also had eyewitnesses identify Gilbert in a line-up that was conducted without notice to his attorney. During the trial, several witnesses identified Gilbert in the courtroom as being a part of several robberies; it could not be determined whether or not identifications in the court room were a result of the illegal line-ups that occurred before the trial.

James Gatz, 30, had been killed in the Fall of 1922, and he did in fact deserve it. Gatz was not an honest man and always kept his secrets, and he even died with a few of them. For those who do not know, this man was in fact a criminal responsible for many crimes, one specifically was aggravated vehicular manslaughter. James Gatz is responsible for bootlegging, a federal crime as it directly violates one of the acting Amendments of the United States Constitution at the time. Not only that, but James Gatz lies about his past throughout the story.
Jimmy could care less in in his early childhood about what goes on around the world , however when it comes to the fake scientific advancements he has a concern about them. Later on he proves this concern because after everyone is gone he knows how messed up the world is. Natural life can no longer prosper, since even fake trees were made and animals were being formed to be fake too. The scientific advancements made him cherish life more because he knows he is starving and not comfortable however, he tries to still live in order to just keep the human population alive so the future world would not be all synthetic and to try to make Earth valuable again with natural elements. He chooses to stay on the planet in order to try and preserve it and although unhappy he deals with it to show how much he worships

When Jimmy was given a 4 year sentence, Jimmy already knew “with as many friends on the outside [he] had”, gained from Jimmy’s wealth and respect, he wasn’t going to be in prison for long. Because of everybody’s respect for Jimmy, Jimmy was even able to gain “the finest set of burglar’s tools in the East”, which led to more fame, more money, more respect, and more friends for Jimmy Valentine. Jimmy was able to settle down in a town for a whole year before he was found by one of the greatest detectives alive. Jimmy’s respect that he was able to obtain created power that many people didn’t
Even though before he left prison, the warden attempted to convince Jimmy to stop the mugging, Jimmy robbed a bank in Indiana a week after his release. Furthermore, Jimmy deprived a bank in Jefferson City; he stole five-thousand dollars from that bank.
Even after Jimmy molested his daughter, he could still have attended family therapy with Claudia and his wife. This characterization of Jimmy is clear in his clothing and his boarding room which is small, simple and above a restaurant. At this point in the story, Jimmy loves his tools which he uses to commit crimes. “He opened [the bag] and looked lovingly at the tools for breaking open a safe” page 48. Jimmy eventually decides that he will no longer engage in safe breaking. The author tells us this directly on page 50 when Jimmy writes the letter to his friend
(O. Henry 1) Jimmy was in prison and that's not a good thing. But soon in the story he turns his life around and does try to be moral and respectful, unlike the beginning. Finally, after Annabel asks him to save Agatha, Jimmy agrees and “with that act Ralph D. Spencer passed away and Jimmy Valentine took his place.” (O. Henry 5) O. Henry puts it this way because Ralph D. Spencer wouldn’t and couldn’t crack a safe while Jimmy Valentine would.
While it is true that Price witnessed Valentine breaking into the Elmore Bank’s safe, Jimmy was only doing good. He meant no harm to others. In fact, all he wanted to do was rescue Agatha from suffocating inside of the safe. Once Agatha was safe in her mother’s arms, Jimmy made a courageous decision and confronted Ben Price to admit his guilt.
Jimmy Valentine got out of jail and started robbing banks again. Then he went to a town to rob another bank and falls in love. He should stay free for three reasons. First, he stopped robbing. Second, he is making an honest living.
Jimmy improved his integrity on moral character. He could have gotten in trouble with the police if they found out about his secret identity. Even bad people can become good people if they try hard

Jimmy Valentine was dedicated to living a moral life because he moved to a different town, changed his name, and got a normal job away from his “past life”. To start off, people might think that Jimmy wasn’t dedicated to living a virtuous life because he continued to rob banks after he got out of jail. While this is true, Jimmy did eventually stop robbing banks after he was released. In addition to this, some may claim that Jimmy was not devoted to living a moral life because he broke open the vault at the end of the story. Although Jimmy did break into the bank vault, he didn’t do it to steal money. The reason he broke into the vault was to save Agatha.
