The Duke lacrosse case implicated criminal actions of: first degree rape, first degree sex offenses’ and kidnapping charges against three Duke University lacrosse players; Collin Finnerty, Reade Seligman and Dean Evans (North Carolina State Bar v. Nifong, 2007,p.18-20). According to Mosteller (2007) the case started with “gang rape allegations” by Crystal Mangum, a black exotic dancer who was also a student at North Carolina Central University on the morning of March 14th, 2006 (p.1337). The alleged rape occurred during the Duke lacrosse teams’ party at 610 North Buchanan Blvd (North Carolina State Bar v. Nifong, 2007,p.1). Suspiciously Mangum could not make any identifications of her attackers even after viewing most Duke lacrosse team members including the names mentioned above and the lacrosse team members who actually lived at 610 North Buchanan Blvd (Mosteller, 2007, p.1407). One of the detectives investigating the crime talked to Timothy Cole in a parking lot near the crime scene. Since Timothy was black and close to the crime scene she thought that Colin could be responsible for the rape. The detective followed Cole and took a Polaroid picture of him. Latter the detective showed the picture of five suspects including Cole.
In the article “Cole Case,” the author, Jena Williams writes about Timothy Cole, a falsely accused man charged with 25 years in prison for a crime he did not commit. Known as the Texas Tech Rapes, four women were raped from 1984 to 1985. As police searched for the rapist, Cole ran into an undercover cop on campus and told her his name and where he lived. Although not suspected to be the rapist, police ran his license plates and discovered Cole recently filed it as being robbed. Claiming to help him by investigating the robbery, police took Cole’s photo and placed it in a lineup of other mug shots.
In July of 1984, in Alamance County in North Carolina, an assailant broke into the victim’s – Jennifer Thompson-Cannino – apartment and attacked and raped her. Later on that same night, the same assailant broke into another apartment, attacked and raped a second woman. Jennifer Thompson-Cannino, was a 22-year-old college student at the time. She had never met the defendant, Ronald Cotton, until she picked him out of a line-up as her attacker and rapist. Ronald Cotton was initially convicted based only on the victim identifying him as her attacker.

On June 14th, 1920 Sandra Teal went to the fair that was in town with her boyfriend Robert Walsh, and later that night she claimed six black circus workers raped her. The report of the rape was called in early morning of June 15th by Robert Walsh’s father. There was little to no evidence to support these claims and an examination of Sandra by Dr. David Graham, a family physician, showed no physical signs of rape or assault. Six black men were arrested that day and immediately brought to the Duluth police station. As news spread around Duluth about what allegedly happened, a mob started to form and by the time the mob decided to force its way into the police station estimates had the mob as large as ten thousand people.

Do you view the young woman as a victim of rape, even though she was under the influence and the defendant never penetrated her with his penis? - Yes, I see the young woman as a victim of rape because whether or not he penetrated her with his penis, he had the intent to because her underwear was off, her legs were spread open, he was erect, and he was on top of her as if he was having sex with her. Also, the young woman was unconscious at the time and had no idea this was even taking place. Brock Turner clearly had gone after someone he knew he could get something out of because at the time the victim could not verbally consent to him.
Many words come up when thinking of ‘College’, some of which are: learning, independence, goals, party, and freedom; although, that’s not always the case. At residential colleges rape culture has grown tremendously throughout time. In the article, “Mishandling Rape”, written by Jed Rubenfeld completely analyzes and supports the problem of rape in colleges throughout the United States. In this article, he establishes the importance of his argument, the audience he is hoping to speak out to, various logistics, and has a strong ethos appeal which supports his argument.
In previous court cases, such as Manson v. Braithwaite, the Supreme Court deemed that if identification can be determined to be “reliable”, such evidence could be used. The study continues further to document a specific case of mistaken identity. In 1984, Ronald Cotton was sentenced to prison for the rape of 22-year-old, Jennifer Thompson. While many were pleased that a rapist was off the street, the police has gotten the wrong man.

In society and college campuses, sexual assault occurs quite frequently. According to an estimation one third of women experience a forced sexual experience at least once in their life and most of the time it occurs in colleges. Men have also been reported to be victim of sexual assaults mostly by other men. Most of the time the sexual assault is planned and perpetrated by a third person, who is known to the victim of incident. Drug and alcohol use play role in this issue and contribute to the problem as most of the time the victim and perpetrators are under the effect of alcohol or any other drug during the incident.
