In a retributive justice system, the state is tasked with bringing Blanco-Garcia to justice. The state will accuse Blanco-Garcia of murdering Vanessa Pham and hold an adversarial trial to determine whether he is guilty of the crime or not. An appointed defense attorney (DA) will represent Blanco-Garcia at trial. Due process demands that the defendant is afforded legal representation to argue matters of law on his behalf as well as to protect the defendant’s other due process rights. Likewise, the state will also be represented by a legal agent, the commonwealth attorney (CA).
To do this, they used various pieces of evidence and testimonies to convince the jury of their argument. The jury then decided whether or not Arias was guilty based on the claims of counsels, defense and prosecution. Prosecutors have the power to send offenders away which allows them to make harsh decisions. They offer plea bargains to offenders which often will enable them to do time in prison. Pfaff stated that "as long as prosecutors simply use the tough laws as a bargaining chip, not real punishment, legislators can reap the political benefits of looking tough on crime while avoiding difficult financial decisions" (Pfaff, 2017, P136). At this time, decisions regarding bail are also made. Sometimes—but not always—the next step is for the defendant to appear at a preliminary hearing, where it is decided whether or not probable cause exists that the defendant committed the crime he or she is charged with. Next, a grand jury hears the state's evidence on the case and may or may not bring back an indictment against the defendant.

The United States Criminal Justice system has a unique way of approaching and handling criminal trials. In criminal trials there are important court room members with specific roles and certain court room procedures that must be followed. The court room members include the jury, the judge, the prosecution, and the defense. Some of the procedures of a criminal trial are arraignment, preliminary hearing, the trial itself, opening statements, direct examination, cross examination, closing arguments and the verdict. Each court room member’s goal is to fulfill their responsibility and to help justice be served.
The Ohio Supreme Court is made up of 6 Justices and 1 Chief Justice and the majority of the case they handle are appeals, while the U.S. Supreme Court is made up of 8 associate Justices and 1 Chief Justice. There are 12 appellate districts in Ohio, and the state Supreme Court is mandated to hear appeals of cases originating in the appellate courts, as well as cases concerning the State or U.S. Constitution, and the death penalty.
