Every community faces obstacles. In some cases, it’s a drug epidemic, in others it is violent gangs. But, no matter where you go in the country, every community faces domestic violence issues. Thousands of men, women, and children are victims of domestic violence each day across the United States. Many times, during domestic disputes, perpetrators will use firearms to intimidate or harm their spouses or partners. Not only does this create an already dangerous and deadly situation for the victim, but also the law enforcement officers who may be responding to this domestic dispute. This bill, Maryland House Bill 1646, requires when a defendant is charged with a “disqualifying crime,” for example domestic violence, the State’s attorney must serve written notice to the defendant, the defendant’s counsel, and the court, that under State law the defendant is prohibited from possessing or owning a regulated firearm, rifle, or shotgun. Bills and laws such as this have been proposed and passed in other states. However, this bill also states that the defendant must transfer all firearms within two business days to a law enforcement official or federally-licensed firearms dealer and provide proof of the transfer to the court. The goal of this bill is to not only protect victims of domestic violence but also law enforcement officers. By prohibiting perpetrators access to firearms, it begins the first step in intervening and helping prevent future domestic and gun violence. Maryland House Bill 1646 may be the first step in the right direction to prevent these two national issues. The purpose of my senior project is to research and analyze data and studies regarding the use of firearms during domestic disputes and police involvement in these incidents.
