On February 18, 2016, I conducted telephone interviews of Andres Lopez and Chris Clawson. Mr. Lopez stated that at the time of the incident, he was driving from a Haas-Anderson work site to the company’s office to drop off some supplies and equipment. Before leaving the work site, he stacked four traffic control barrels, weighing between 4-5 lbs. each, on top of one another and laid them in the bed of his truck. The barrels were laid on their side and were completely inside the bed of the truck. He used a nylon rope to secure the barrels. The rope was strung once across the top of the bed of the truck. He had been driving the vehicle for approximately 10 minutes before one barrel dislodged and flew out the bed of the truck. His vehicle was in the center lane of the highway when the barrel came out. He noticed the Plaintiff’s vehicle at the same time the barrel came out. The Plaintiff’s vehicle was in the center lane and transferred into the far left lane to avoid hitting the barrel. Mr. Lopez does not remember seeing the Plaintiff’s vehicle jerk or swerve to try and miss the barrel. Clawson stated that when he initially got into the vehicle being driven by Mr. Lopez, the barrels had already been placed in the bed of the truck. Mr. Clawson was on his phone and not paying attention to what was going on at the time of the incident. It wasn’t until after Mr. Lopez pulled his vehicle over to the highway’s shoulder that Mr. Clawson became aware of what happened. He did not observe the Plaintiff’s vehicle until the time the Plaintiff pulled the vehicle over to the highway’s shoulder. Mr. Clawson stated that after the incident, the Plaintiff did not complain of any physical injuries and seemed mostly concerned that he may be held responsible for any damage that may have occurred to his employer’s
